i got the RFE too. I hv a BSc Physics. And various other Diplomas including NIIT. However, the qurey read that what has Physics got to do with CS? Pls explain. :eek: Thats all.

Sent i a good response. However, no change in LUD yet.
Stuck at Mar 21!!!! :(

I just found out what my RFE is for. The labor application requires someone with a "Chemistry BSc or equivalent" and "6 months experience".

I have a BSc in Pharmacology and a MSc in Chemistry from Canada. Apparently the USCIS doesn't think it meets the requirements. The lawyer thought it was pretty outrageous.

The lawyer is going to respond in the next few weeks.

Officer code: NSC/SPK WH193

I transferred a number of credits from one university to another, then completed my BSc. It appears that the USCIS thinks that I don't have a 4-year degree because of this. This is despite the fact that my transcripts list the courses I transferred as being required for the degree.

RFE:According to evidance submitted, your beneficiary is residing in Dallas, TX and the position offered is in IOWA. The labour is from IOWA. As your beneficiary is not working in IOWA, the LCA is not valid. Please submit the evidence that the benificiary is working at the place where LCA has been approved.

RFE Reached on : 14 th June.'

Hello guys
Still cannot believe it got the approval email after RFE on 4/27/05, replied on 6/22 , received on 6/23 lud on 6/24,6/28/6/30(approval email). My PD is Dec 2002 and am from retrogressed country. RFE was for 2004 company returns, my 2004 W2 and current paystubs.

lca IS lABOUR CONDITION APPLICATION.iF YOU ARE WORKING IN dALLAS THEN YOU NEED TO HAVE lca FOR DALLAS.IT IS ILLEGAL TO WORK IN A PLACE WHERE YOU DONT HAVE LCA.I DONT KNOW HOW COME YOUR ATTORNEY DIDNT NOTICE.MOST OF THE TIME DESI EMPLOYERS IGNORE SUCH A SIMPLE THING.

Yes, I do have the same officer. My case is LC substitution case. what about yours? I received an RFE in May (EB2->EB3, W2, EVL, company taxes, paystubs, ETA 750 Part-B). I submitted the RFE on june 14th. Till now I did not receive any email or LUD change. Hope I won't get another RFE. Did you work anytime in IOWA. Then it should not be a problem. Lawyers knows how to reply to this kind of RFEs. They know the loop holes in the old labor system better.

Got RFE on on my I140. Its about "Ability to pay". My Employer has submitted the requested documents and there is a LUD change yesterday saying " we received your response...blah..blah..". Just keeping my fingers crossed..

I got very serious RFE about w-2. Please guide --

I came in the USA in Sep 2000, however I got my first project in March 2001. USCIS asked me to produce w2 of 2000 till 2002. I can not produce w2 of 2000 because I never got one. They are asking to produce w2 of 2000 because my application is showing experience in 2000. In fact I worked on a training project in 2000 (which looks like a actual project in application).
I dont know how to convince USCIS that it was actually a project in a Training Program I had gone through in 2000.
Please please guide.

Sorry to hear that you got second RFE. I dont know how these NSC people work. We all already have issues with single RFE and now they started sending two RFE. Oh NO... Talk to the attorney and Your employer what they can do for you. I wish you GOOD LUCK to you and all of us.

Sorry to hear that u got 2nd RFE. what does ur attorney say? Be careful that when u say it's training, Service center's might not like it! say, it's like unpaid project as they wanted to check ur skills for 2-3 months, and if they were ok, they would start paying u since 2001. not sure if this will work but just my take! also, check with ur employer and get details of the paycheck issuing company and enquire if they can issue a W-2 for unpaid salary in 2000 which is something like ur company should prove to them... If yes, put ur own money in company's acct, ask them to deduct taxes and then direct the paycheck issuing company to issue paychecks.

If this sounds too complicated, maybe even try that u were paid in Indian currency for the 1st 3 months of employment in India and that u were given just expenses/ accomodation here.....

these r all my suggestions! might sound foolish too..... but just explore.

also, i saw that u had an RFE about education. pls let me know what it was about and how u responded as i have an RFE on my edu too and looking for advices..

Sorry to hear 2 nd RFE.

Here is the idea.
1)You can say that you were under trying for 3 months like that
2)second , say that you were not feeling well for one month.

For evidance , you can produce medical certificate for 2000 sep time ( get it from india if you knoe any doctor )

This is just an idea.
Deal the issue carefully according to which you fee safe and better.

I was looking at ur posting, even I got a similar RFE on my educational evaluation. I do have 4 year engg degree and no clue why I got this RFE. Please let me know from where u got this educational credentials done.

Hi NSC04Filer,
My LC is from IOWA. I have LCA(H1B filed) in texas as I am working here. My company filed labour for me. Thanks for the encouragement. After, My Attorney replied, RFE, My status didn't change. RFE updated on June 14th. No change in LUD.

Congrtulations!! Mine(Exp.letters) is submitted on 6/28/2005 and so far there LUD on 6/20,7/1 and 7/5.
Can you please provide us your officer code?
