I-140 Question

Hi,

With my current employer, recently my Labor got approved and the Lawyer is working on I-140.

Here my question is, with my previous employer both Labor and I-140 got cleared. So is there any way that the new company can make use of the old I-140??

If so what I have to ask my Lawyer regarding this.


Please help me in this.

You cannot use the I-140 approved through one company for another company's case. You cannot even use the approved labor filed by one company, for use with another company.
The only time someone can make a substitution is when a company files the labor for employee A, gets approval, then employee A quits the company and employee B of the same company can use the approved labor to file I-140, that too if he sticks with the same company. This doesn't apply for I-140 cases, no matter what it is.

In short, a company to company transfer of approvals is not allowed but within the same company, labor substitution is allowed between employees if the employee on whose name the labor was approved, quits. For I-140, nothing works.

My prospective employer who sponsored my case has around 5 employees on payroll. The documents he submitted include 1,2,3rd quarterly reports of this year and company bank statements starting from Feb 2002 - Oct 2002. My labor moved to federal level in Mar 2002. So the officer asked for proof of ability to pay wages since Feb 2002.

My online status of I 140 says "This case has been approved".

I 140 - RD - 08/06/02

AD - 11/21/02. No RFE's

EB3/RIR

I think guys who applied in the last week of JUly or first week of August would get their approval before Thanks Giving weekend.

Congrats on your approvals! I am waiting for its approval close to 5 months now!!!!! I am sure I will feel more alive once I hear my I-140 is approved. ND June 25.
Question: are any approvals possible on Saturday? I do not want to wake up for nothing tomorrow! Also gcard2002, how often do they update the online system? Do they update the moment they approve or is it at specific timings only?

I have seen cases where the status was updated online the moment the officer acts on the case like approval/RFE/denied and I have also seen cases where the status wasn't updated online for 2 to 3 days (max) after the officer decides on the case. After checking the status in the evening after the work hours of the INS service center, it is a good idea to check once again the next morning. That includes Saturday morning too for Friday updates. No use checking on Sunday morning. Mine was updated within minutes the officer approved my case.
 
EAD approved

I did concurrent filing and my I-140 was approved recently on 11/20/02. Yesterday 11/27/02, my EAD was also approved. It wasn't updated online until yesterday night but when I checked today morning, it shows the case was approved. My advance parole is still pending, though I am not really looking forward to advance parole. With that, I am done with all stages except I-485 approval. I hope that the INS approves my I-1485 before the expiry of the EAD on 11/27/03. Good luck to everyone.

You can go to the INS website at www.ins.gov to see their holiday schedule. It's there.

As far as your I-140 is concerned, this is what you are supposed to do. If the time specified on your I-140 receipt for processing expired, you are eligible to call INS service center to get an update. You means, your lawyer. They won't answer questions from you unless it is I-485 petition, which is your petition unlike I-140 which is employer's petition. They will tell you what is the status. Also, you must have seen processing times posted on various immigration sites. Though they are not official, they are the actual times. You can use that information also to make your lawyer call the INS to see why your petition is still pending when there are cases that were filed after yours and got approved.

If the processing time on the receipt did not expire, then you have no choice but to hope for immediate approval.
 
I-140 Question

Hi,

Can any one tell me what is the difference between different I-140s, like A, B, C, ..... I see lot of categories there.

Mine is EB2/RIR and having M.S. in computer science from USA. Which category I am going to be??

For your information, I-140D's processing date was 7/26/2002 one week back. But now it is saying 4/18/2002.

Does the processing date will go back???

No 140 and 485 receipt

My case (EB3, RIR) was filed to INS, both 140 and 485, on 10/28/2002. However, up to now I have not got receipt yet. Is this normal? Thanks.
