My attorney has replied to the RFE I got in my I-140 process some two weeks back..Does the INS acknowledge receipt of the reply.Any one please clarify!

INS does not acknowledge receipt of response to RFE. The onlyway to check if they received the reponse is check your case status online/AVM. It will showup there stating that INS received your response to RFE on xxxxx date and it will take so many days to process it. That's it.
 
The online case status for my case reads as follows,

On November 27, 2002, we received your response to our request for evidence or information. It is taking between 150 and 180 days for us to process this kind of case. However, because preliminary processing was complete before we requested the additional material, the remaining processing time for this stage of your case is approximately 180 days. You will receive a written decision on this case.



Does it mean I have to wait another 180 days,my case was filed on july 18th.I intend to go for CP.

I had the same message after my employer and attorney responded to the RFE on OCt 26. INS cleared my I-140 on Oct 31, 2002.

So brace yourself for a I-140 clearance soon enough.

Irrespective of what message is posted by INS, they are actually coming to a decision in 2 to 3 weeks. Mine, they took 11 days after receiving the RFE. Good luck.

It is not true that you will get decision in 2 to 3 weeks, because mine almost crossed 8 weeks........till now no decision.......so you can't say exact time..........

Your case is more like an exception rather than the rule.
When we speak about the time taken by INS to decide on our response to RFE, we always talk about general processing time. i.e 2 to 3 weeks. We have seen cases where there are many I-140 approvals for Aug and Sep 2002 while there are couple of guys who filed in Apr 2002 and didn't get approval. So, we cannot quote those two cases and say that the INS is still processing April 2002 cases. I have noticed from your case details that you took close to 45 days to respond to RFE while I took care to respond in 2 weeks. Someone told me that if we keep INS waiting too long for our response, they might throw the case back on the shelf. As expected, they decided on my case in 11 days.

Notice and Reciept date: Oct28,2002

Happened to check last week:
Ins message says:
This case has been approved. On November 15, 2002, an approval notice was mailed. If 14 days have passed and you have not received this notice,---

Issue: Approval notice not yet recieved!

Verified with the company and they said they haven't recieved approval notice. Its more than 17 days!.

My attorney said he cannot file I-485 without I-140 approval notice..

Please advise me on this issue

I hope what you said is true it is 4th week since i replied to rfe on nov8th (it reached Ins) i am still waiting for a descion, i took 21 days to respond ,

When you enter your LIN number on status page on web (https://egov.ins.usdoj.gov/graphics/cris/jsps/caseStat.jsp) , you will see similar message........

On Novemeber XX , 2002, we received your response to our request for evidence or information. It is taking between 150 and 180 days for us to process this kind of case. This means they have received your RFE.........

I-140 Receipt Notice

My I-140 (EB3) petition was filed by my Attorney last week. I'm planning to go for Concurrent filing of my I-485, EAD and AP petitions. But the Attorney says my I-485 can only be filed after getting the "Receipt Notice" for my I-140 from NSC. How long does it take to get I-140 Receipt Notice?
