Hi there,

I applied for an sylum in the USA. I got an NOID today. They've given me 16 days to respond with a rebuttal. They said my case was well-explained, well-detailed, satisfactory and credible and that I had given enough evidence of the amount of fear of persecution I had but I didnt have enough evidence of a practical physical abuse in my country.

I am an Ahmadi Muslim, persecuted for my faith in Pakistan. Can anyone help as to how to proceed? I took up my case myself without the help of an attorney. What should I do now?

Thanx Lazerthegreat, that was a good reply! but to be honest, I did write about all sorts of psychological stress I went through all my medical school years. I think I'll need to write ALL incidents I could thin of specifically and not generalise my application. And yes, this time I'll take an attorney with me. :(
 
Plz also tell me this: If a hospital sponsors me an H-1 Visa in March (I am legally allowed on a B-2 here till April), and even if the asylum is denied, that would not in any way affect my H-1 issuance, right??

No it won't be affected. you can pursue multiple avenues towards GC at the same time. Have you passed US MLE and trying to settle in the US? Can I ask your location?
 
Yeah I've passes all my USMLE exams. I am in Baltimore, MD these days. How about you? and you're also an Ahmadi Muslim right?
 
I am not sure I understand. Did the letter say that you proved future persecution but did not have suffer past persecution?
 
Kash MD, lawyers have their weights in Immigration cases, I think if you had a lawyer in your case you would have a better chance in getting approved.
Let's not talk about the past, get yourself a good immigration lawyer to respond for the NOID and can continue with you to immigration court. Good luck man.



I think you should gain some evidence of extreme "mental torture" due to the persecutions by these (deleted by moderator).

We are here in USA for a new begining, no need to use bad language towards any group, Muslim or Christian or whatsoever. Please don't blame the religion.

I wonder how you will get the US citizenship in 2010 with such attitude.

what they are saying is that due to the fact that you did not suffer any physical tortune automatically means you did not suffer past persecution. This is retarded...

But usually the NOID is used as formal ground to refer you to the IJ. I understand how emotionally touched are with the response, but sometimes it seems to me that the immigration officer takes a shortcut just to refer you to the IJ when he/she is not sure about the case. At the IJ you will have the opportunity to add more information to your case that help the judge clarify any doubts that the immigration officer might have had.
Sometimes the eyes and experience of the immigration attorney might help you making your case across to the immigration judge.

I wonder if you asylum claim is real if you don't even hate the subjects who persecuted you.....

The OP's case will not be referred to an IJ because he/she is still in valid status.

Kash - Please provide the exact language used in the NOID.

If you establish well-founded fear of future persecution you do not have to establish that you suffered past persecution.

This tells me that just because Kash was not "beaten-up" in his COP, he doesn't deserve asylum. Maybe Kash can spread more light on NOID.
 
hey guys, I just found out that my case has been forwarded to the National Headquarters (I guess at U.S. Citizenship and Immigration Services 425 I Street, N.W. Washington, DC 20536). Do you guys know why they forwarded it here? Any idea?

I am surprised they issued NOID and at the same time they forwarded your case to National Headquarter. How you came to know that your case has been forwarded to National Headquarter. I mean did they send you a letter in the mail or you talked to them personally.

I am also physician from Pakistan, took asylum interview couple of weeks ago and still waiting for the decision. They called me last week and told me that they will mail the decision. My J-1 has been expired and currently not in any status.

What should I do, should I call them or send letter in the mail and inquire about decision.

Yes I did. She submitted my application but she withdrew her representation just two days before the interview due to non-payment. So I went for interview by myself.

How you came to know that your case has been forwarded to headquater.
 
Hey Kash,

By the way I would also suggest to maintain your visa by either applying for B1/B2 extension or change of status to H-1 or change of status to F-1 etc.
