Newbie in Distress! Special Circumstances

Hi There,

I have a rather unique situation and not sure how to go about it, hoping someone would kindly help me. My wife and I are interested in immigrating to the USA primarily to take care of my wifes aging older 2nd cousin. My wife has no parents and no contact with her two sibling, her cousin is also alone, no parents, sbilings or children. She has asked us to come live with her and should would sponsor our immigration. However, from all of the research I have done, this seems next to impossible. I do work for a large corporation, who although is willing to transfer me to a US office, will not partake in my immigration at all (they have a policy against it) and will only accept a transfer request once I can legall work in the USA and can prove it to them. I called our local embassy, and they told me that although it would not be impossible , it is rather difficult. Anyone ever hear of any sort of special accomodations in a situation like this? They person on the phone directed us to the USCIS info line, however, this line is not accessable through Canada.

Thanks in Advance!

your cousin cannot help you with immigration. You have no other options besides DV lottery, investing $500K-$1M into US economy, finding an employer who would be willing to sponsor your GC, and a political asylum. That's short of your wife marrying a US citizen.

Lots of people would just love to immigrate to the US to take care of their aging cousins.... However, US immigration laws just don't work that way.

If your company is temporally going to transfer you to their office in the US then they might be able to get you an L-1 visa. However, there are some strings attached to that. You might want to review the requirements for the L-1 visa. BTW, a L-1 visa is a non-immigrant visa.

Your wife's cousin could always move to your home country; in fact, it would be far easier for her to relocate than you since she would not have to worry about employment. You are just using this as an excuse to try to bypass US immigration laws and the millions of people with even more compelling reasons to relocate and are unable to do so.

I really resent that last comment I would like to kindly ask you to not make assumptions about my situation, nor my reasons for immigrating. Thanks to others for their opinions, I will look into emailing the USCIS as well as researching an L1 visa.

If you're a Canadian citizen, you can also look into a TN if you are employed in one of the TN professions. However, there aren't any avenues to immigrate simply based on your second cousin relative.

Your heading stated you had "special circumstances" and indicated that you should be granted priviledges not available to others simply on the basis of your wife's cousin's situation. Cousins - even needing care - are not qualifying relative. If they were, I would have petitioned for mine who is in far more dire, life threatening circumstances many years ago!

Your further discussions clearly indicate that your primary motive is to work in the US because you completely dismissed my suggestion that the cousin move so you could care for her at your current home. If your primary interest was the well being of the cousin, you would not place your US employment need so highly. Your motives are clear.

If any should be insulted it is those who so patiently wait for years and abide by all of the rules having to deal with people who think they are "special". In the "special" category, your case is pretty low on the list. There are very ill LPRs whose family cannot join them due to the wait. There are citizens with disabled siblings who likely will never be able to come due to regulations. I could go on but why waste my time.

Thanks so much for your response. Again, I would kindly ask that you do not assume what my situation is , nor the circumstances surrounding my immigration are (nor the medical condition/concerns that my family member has), because based on your assumptions it is completly incorrect. Unfortunatly her moving here is simply impossible as well, for other circumstances which are not your business to be honest. Thanks for your insights. However, I am just looking to hear some insights and comments and possiblities from others. Thanks anyhow!

ps- Did anyone tell you what happens when you make ASSumptions:confused:?? Clearly not:(

in my assumption the federal government thinks just like a giant corporation, if your case presents an opportunity to make profits and/or reduce expenses, you will get what you are asking.
just make a case that you will be taking care of your relative (and you are!!!), cover/help with her/his medical expenses (less burden on federal budget?), etc. they'll love it if you present it that way, i guess.

I think 'concerned for US' has some serious anti-immigrant agenda/issues going on, judging from his/her comments here and on other threads. Just ignore and move on.

and what would be the basis of his immigration petition?

It seems the quickest way for you to get to the US is on an E 2 investor visa. You would put an offer in to purchase a business subject to E 2 visa approval. There is no stated figure of investment the just say "You must invest a substantial sum of money. Most Brits sell their UK assets and move to the US this way
