Fragomen - also my attorney - is a very conservative firm. Not that that is a bad thing but...
The statement made by them should be "there is some risk if you are from a retrogressed country".
Also, considering that you can ammend your old case,ie you can update address, etc. then the risk of making the new case different is reduced.
However they are being truthful, DOL does not have clear guidelines of what an identical case is.
