H1 stamping in Ottowa

It went very well.
I was not even asked for all my documents.
Only ones asked for were: Approval letter I-797 (of course ), Letter from Employer. DS-156, DS-157.

I was going for the H1 visa extension, not a first time H1. I have been with the same company all along.

Questions:
When did you come to the US ?
Did you come on H1 ? ( no I came on F1 )
How many people does your company employ?
What does your company do ?
Any other companies you worked for ?

Interview lasted only for 5 min.

I would be glad to answer if anyone has any questions.

what if visa stamp expired ?

if the visa stamp in the passport is expired, can we go canada and get it stamped ?

what if gets denied ?

thanks Laborpains. but what if it gets denied(assuming that we have a perfect case), can we enter US again without going back to our home country ?

I would doubt that they would allow someone into the country without a valid visa.

appointment ?

did you have to take an appointment or went straight to the consulate ?

Address Change-How to inform BEC

My company, my lawyer and me all have changed addresses recently. I think my labor is at the BEC right now as I filed my application in Oct 2002 to NY SESA. Can someone help me in how to inform the BEC about this change as they will send the 45 day letter to the wrong addresses. I have no tracking number for my case but the only number that I have is when I requested for a letter from SESA for my 7th year extension they had a number on that letter. My lawyer, as always clueless. I will greatly appreciate this help.

going to canada seems risky ?

just to let u know, this is from nvars.com

Note: The Visa Appointment Reservation System is intended for use by persons in the U.S. and Canada. Persons physically present in the U.S. or Canada may obtain an appointment and apply for a nonimmigrant visa at one of the U.S. consular posts in Canada. Please be aware that it is generally more difficult for applicants to obtain visas when they apply outside their home country. Consular officers in Canada may be unable to properly assess the circumstances of and/or evaluate foreign documents presented by applicants who are visitors in Canada. In such cases, the consular officer may deny the visa application and recommend that the applicant return to his/her country of normal residence. For this reason, persons applying for F, M, J, H, or L visas, who are presently in the United States on a B (tourist or business) visa or on a visa waiver, are strongly advised to apply for their new visas in the country of their permanent residence.

Visa Appointment Reservation System

ATTENTION
Due to an April 1, 2002 change in regulations, applicants will only be able to re-enter the United States if they are found eligible for a new visa and actually have the visa stamped in their passport. I-94 forms (even if valid), accompanied by previous expired visas, will no longer be valid for the automatic re-entry of persons from Canada or Mexico if during their visit they applied for a new visa that has not, in fact, been issued.

I think it is risky too. Considering that if for any reason you do not get your visa stamped you will not be able to re enter the country. My lawyer said especially when you have degrees obtained from the foreign university other than US and Canada they have difficulty in assesing your degree equivalent to US and Canada degrees. (I am not sure how much it is true?) With proper documentation we should be able to get the Visa stamped.

visa stamping for the 7th year ?

anyone here got their 7th year visa stamped either from canada or from your home country ?

Thanks in advance.

The DOL has updated its public disclosure files and makes available the record of the following applications filed by each employer:
Permanent Labor Certification Application (2000, 2001, 2002, 2003, 2004)
H-1B (2002, 2003, 2004)
H-2B (2000, 2001, 2002, 2003, 2004)
These files are Zip files and for the instruction to open these files, please click here.

There are links to MS access db. I'm guessing these are the things already entered. I wasn't sure if I could locate myself. Keep in mind these are for FISCAL YEARS (october 1 to sep 30).

Is this valid? Have these people been entered?

the database useless to those whose

cases not opened yet as of 10/31/2004. I believe 99% of the people who are on this forum fall into this category.

myself and my wife went to ottawa and gout our h-1s stamped in feb. mine was a h-1 extension. her's was a first time h1 (she had a h4 before). both of us had masters degrees from india (no education in US).

The process could not have been smoother. Took an appointment thru nvars.com...filled up ds-156 online and took a print out. Appt was at 9.30. reached at the right time on a cold morning....they took our passports and ds-156 and 157 and the fees ...Waited for half hour and then called for an interview... They just asked to give the letter of employment from the company. No paystubs ,W2 etc. although i was prepared with all the docs...got my passport same day at 3pm.....

I would definitely recommend canada.....can couple it with a good Montreal-Ottawa vacation too!!!

Can I too do that?

Hi Guys,
Srikums thanks for that update.
I changed my employer last sept. My current H1 stamped on passport will be expiring in Aug this year. Can I have my current employer's H1 stamped on my passport from Ottawa Canada instead of doing it from India? :)
thanks in advance..

Advise for Me Labor filed in June 2002

Hi Everybody,
I came to know of this forum some time ago and scrolling back to a few posts I am seeing contradictory suggestions for cases like me in the forum than what I am hearing from people outside.
My Labor was filed in June 2002, RIR. I read earlier for a similar case the suggestion of the forum was to wait in queue and not file a new application under PERM.
Is it still the opinion of the forum. Please advise. It is really very painfull.
