Question to my alumni

Guys,

I saw my case details posted on this forum.I actually did got my I-140 approved in 15 days from the Receipt Date. A question on the Priority Date thread.Does this PD apply to Consular Processing as well.How does it work in my case.Details

LAbor Applied : 07/10/2001 /LAbor finally certified 07/14/2004 ( good wait of 3 yrs at the NY LAbor Dept).
I-140 approved on Sept 15th 2004.

Applied for Consular Processing

PD does apply to Consular Processing as well.
You are EB-3 right? So based on the predictions January 2005 is when date will retrogress. I doubt you have anything to worry because your PD is likely to be one of the oldest ones out there (courtesy of such a long time waiting for LC)

But for description pursposes, this is how I believe this works:

If you picked CP when applying for I-140, VSC will send I-797 to NVC. I think this happens automatically at this point ( I know you are thinking about switching to AOS). This only happens if your PD is before PD being processed. Right now priority dates are current so I imagine your I-797 will be sent in the next 2-3 weeks.

NVC is going to send you Packet 3. You complete Packet 3 and send it back. NVC reviews if everything is ok, they request visa number from the State Department. This is about 8 weeks after you send Packet 3 back. I think this is really when they check your priority date. If it is current it proceeds.

Once they get the visa number your interview gets scheduled.

Since we applied to SEAS in the same day ( one day difference ), so please correct this scenario if it does not make sense:

- Applied in SEAS MID NOV 2001
- Approval by SEAS , hopefully , October 2004
- Transfer to DOL , Nov 2004
- Approval by DOL , March 2005 ( with assumption that no one is working in holiday season )
- Apply for I-140 and I-485 April 2005
- Approval on I-140 August 2005
- Approval on I485 ( hopefully before we retried ) End of 2005

What do you think ?

Thanks Oberton , that is true currently , but with speeding the process as they promised, the 485 should take less time too.

The earliest date will be 2007.

i am little confused. If your PD is Nov 2001 wouldnt you jump the queue. Likewise wouldnt your i485 be done faster

This is a valid scenario, but not the only possible one. If you are EB-3 even more likely.

Right now USCIS is doing one of two things:

- Approving I-140, then FP then I-485
- Holding I-140, doing FP, approving I-140 and I-485 together.

I think for planning purposes I would assume 12-18 months for I-485 approval.

gcby2020 - You would jump people with an earlier PD only visa numbers are not current but they still go in order of receipt, for example

Visa numbers: PD before 1/1/03

Case #1 Receipt at USCIS 2/15/02 PD 1/1/02
Case #2 Receipt at USCIS 4/1/05 PD 11/1/01

They are both prior to the cutoff date but even though case #2 has an older PD, Case #1 would be processed first because it was received first
 
Thanks JustWatching, I would say I am EB3 for 99% , what other senario you might thinking about ?

Also why USCIS has two method of processing, Based on what the FP request comes first or last of I-140 approval?

Case Filed NY STATE (SESA) : 27 Sep 2001
Case Approved NY STATE : 28th April 2001
Case Approved NY DOL : 23rd Sep. 2004

It took almost 3 years to approved.

Tracker as of 9/24/04

Congrats NYDeal and mike_inus.

Made some updates to tracker.

I have a feeling NYC1999 will be giving us good news shortly.
