New Approval from NY DOL

Another case # 02-506-749 received on 04/27 with DOT Code#030-162-014 was certified

so the dates for you as per tracker ..

are correct?? if SO is your labor still pending with NY DOL?? Presently They are processing April 27th. right?

Well,
I called up again and this time, i got it right. Samething ..i was asked for my lastname, firstname and company name and i got the case #.
I think its just their mood too. Since lasttime he did not entertain me and i could not get the information at 212-3372184.

Re: Labour Question

My company has filed for my labour thru NYC last year. Now I am getting transfered to our NJ office.
Any idea how does my labour get affected ? The company has given me an option I could stay back in NY but if I move to NJ do I have to refile.

as per tracker list , looks like 03/17 and 03/24/01 labers got strucked in NY regional office. even they didnt updated in their AVM system. almost 4.5 months no update on those labers.

Yes - those are the dates. But as I learned, 3/17 is the date the state sent to regional - but (they probably sent my papers by mule to the regional office) they only got it MORE THAN A MONTH AFTER (05/04)

Same case for me. The automated system says received date a month later.
 
Moved to regional

Folks !
I just talked to Regional 212-337-2184, found out that my case has been moved to regional on 07/07. DOT code is 030.162.014 (System Analyst I guess) and she said they are processing May cases now. LC was filed on 08/07/01. keeping my fingers crossed.
They asked me the case no and i didnt know that so they looked it up from my employer name and alian name.

My case was filed on August 21, 2001. AVM still doesn't mention that my case is in Regional.... althought, the state is listed to process September now. So, can we assume that all August cases are now in regional? Are lawyers always notified when the case moves from State to Regional? If not, does it make sense to call this Regional phone number?

See in my case when I called my company they said that they didnt hear anything from the lawyer. If the lawyer of my company is not lazy then it is safe to assume that Not always lawyers are notified.

Do what i did. Call 212-337-2184 abd tell them that u dont have the case number and ask them to look it up by company name and your name.
Also check AVM 212-337-2193 and see if any of the case from your company was moved around or before july ( i mean recent and not certified).

You have to put some guestimate in action to conclude in this kind of situation.
I fought for 2 months to figure out.
 
Not good news, not bad news, just news... and maybe feedbacks from you...

I have an LC pending since 10/21/2001 and I just learned today that my company's getting rid of my department. My options right now are the following :

1- Follow members of my department somewhere else.
Timeline : 2 to 3 months (the time for them to find a place and negotiate my addition to the group)
Pros : I just have to transfer my H1 visa (expiring end of 05) and will probably have a better compensation
Cons : I will have to start my LC from scratch otherwise, I'll just have to leave the US in about a year from now.

2- Stay with my current employer until my LC+I140 clears up, which would allow me to use the AC21 portability. In fact, my employer is willing to keep me in the company (more as a favour from his part than a real need for me to stay), the only unknowns are : what position would I get and how long is he willing to keep me in.
Pros : I keep my LC alive (even if my "new" job could be a bit different from my current)
Cons : I don't know the limits of my employer's patience. At this pace, I don't expect my LC to be approved until Jan05. Then I need to get my I140 approved or wait 6 months, whichever comes last. There's a big chance the I140 might take more time, at least a year, which takes us to Jan06 at least... Ah, also, I might not like at all the job offered, but that's just a detail for now :D

Basically, I'm at the point where I want to live my life in the US and I'm trying to find the best game plan with the current set of immigration rules I know of.
If you have any suggestions, feel free to post them.

I am sorry to hear about that and I would recommend you to go with option 1 in this case:
- if you can find good employer who can transfer you case.
- if you or him can afford expedite the H1B transfer ( cost extra $1000 ) and get it done with in 1 week.
- if he apply for your green card before the of this year, before the 5th year of your green card ended.

other wise I would recommend you stay with your employer and hopefully you pass this hard time.
 
I lost the priority Date

I have been waiting since 2001 for the aproval, on august 2003 thay ask my company to chan the wage and thay did that thru my lawyer. My lawyer went today to see what is happaning with may papers and they said that they did not received the comunication so I have lost my priority.
Does anyone of you know what can i do ???

still need over half a year to go based on current processing progress.
