Not good news, not bad news, just news... and maybe feedbacks from you...
I have an LC pending since 10/21/2001 and I just learned today that my company's getting rid of my department. My options right now are the following :
1- Follow members of my department somewhere else.
Timeline : 2 to 3 months (the time for them to find a place and negotiate my addition to the group)
Pros : I just have to transfer my H1 visa (expiring end of 05) and will probably have a better compensation
Cons : I will have to start my LC from scratch otherwise, I'll just have to leave the US in about a year from now.
2- Stay with my current employer until my LC+I140 clears up, which would allow me to use the AC21 portability. In fact, my employer is willing to keep me in the company (more as a favour from his part than a real need for me to stay), the only unknowns are : what position would I get and how long is he willing to keep me in.
Pros : I keep my LC alive (even if my "new" job could be a bit different from my current)
Cons : I don't know the limits of my employer's patience. At this pace, I don't expect my LC to be approved until Jan05. Then I need to get my I140 approved or wait 6 months, whichever comes last. There's a big chance the I140 might take more time, at least a year, which takes us to Jan06 at least... Ah, also, I might not like at all the job offered, but that's just a detail for now
Basically, I'm at the point where I want to live my life in the US and I'm trying to find the best game plan with the current set of immigration rules I know of.
