Most of Aug Filers moved to Federal.. check the list..

I did check with the lawyer and automated system says there is one case moved to federal. Its just that I dont know if its me or some one else. There are many cases in SESA from my company.

I will post here if I here from the lawyer.

Moved to regional

Hi everyone,

Been watching this "very helpful" forum for a long time and this is my first post to give you folks some hope (I guess!)

Facts:

Case moved to regional
SESA filing date > approx 31July01
Sent to Regional > 13April04

MS Chem Engg + 2 years experience at time of filing. Work for a large company with over 100K employees

A July 23rd 2001 NY SESA received case moved to NY Regional
on April 20th 2004.

Is there any way to find the applicant name from the case number
from NY Regional ?

Thinking positive always. :)
 
Most July cases

It looks like most of JULY 2001 cases moved from SESA to DOL in April....
Nothing hear about any Sept 2001 cases...

What about August 2001 ?

Is there anyone reading these messages whose August 2001 PD is still not moved to Fed ?
 
My PD is Aug. 7th. Havent heard back from the lawyer if it moved to federal or not . One case from my company moved to Fed. I just doesnt know its its mine or not.
I guess there is no way to know the name of the candidate whose case is in federal. Correct me if Im wrong.

I am new to this thread and will like to thank all of you for your vital opinion about the processing for the GC.

I filled my Labor certification in the month of Dec 2001 and have not recd any feed back and its too early for me to expect any reply.

Just wanted to know will this new laws concurrent I 140 & I 485 be any help to my case and also is perm going to be any help to me in getting the GC process faster for me.

Please give me an appr year where i should expect any answer on the LC .

Some thoughts

Hi all,

Just wanted to share some thoughts on some the latest questions/developments that I have seen. They are my opinions and nothing more than that, take them for what they are worth.

Is PERM going to help or not?

I think if you filed in 2001, your labor certification will have probably been determined by October 1, 2004 (when everyone expects PERM to be operational).

If you are a 2002-2004 case, then I think it will depend on PERM regulations and whether it makes sense to convert/refile under PERM.

Otherwise you may just want to wait for backlog reduction centers to begin operating.

When will the LC Backlog reduction centers begin operating?

Who knows. I read that OMB was looking and expected to approve in May. I have only read this in one place so this is suspect information at this time. If this were the case, then backlog centers would begin operating in July-August timeframe. Otherwise my guess is they will begin when PERM begins.

I also think NY will be one of the first states addressed because as we all are painfully aware this is where the largest backlog is.


Are the LC Backlog Centers a good thing?

I think if you are mid2002-2004 case. Yes. 2001-early2002 cases may want to cross their fingers because their cases will probably be in processing during this time of transition and well - who knows which queue they will get put on.

When will your case get approved?

I had originally said that I GUESSED all 2001 cases by August '04.
I still think this is reasonable, but then again I am just guessing.

Will new concurrent I-140/I-485 procedures help?

I think for once we are lucky that we are being held up in LC because only time will tell.

VSC has been cutting down on I-140 processing times pretty aggressively latey. To the point that I am hoping that by June '04, their processing times will be down to 6 months.

I think we won't know the true effects of new concurrent procedures for another 6 months. Only then will we know if concurrent truly takes less time or if just ends up extending the I-140 timeline to match the long I-485 process.

Time may also help in that maybe the pilot programs in CSC (90 day I-140/I-485 adjudication) gets rolled out to other service centers.)

Hang in there guys! 2001 filers, it's so close you can almost smell it.

You can own a company (which is different than being self-employed). You can not be an employee of the company and can not pay yourself a salary. Your earnings would come from the profits that the company makes.

You would need to continue working for your sponsor, owning a business alone gives you no rights to stay in the US.

You also need to look into your contractual obligations with your employer - sometimes there are clauses around what other activities you can engage in while being their employee.

My PD is August 13 and based on my checks with the automated system ( 212-337-2193) it has not yet moved to Federal. Officially NY SWA is in July 01 still but it seems a bit odd given that there are several August 01 PDs after me in this spreadsheet who have already moved on to Federal.
