Update

Two cases from our office that were posted in the regional office on march 3rd have got RFE. Both cases were filed as Software Engineers.

we waited for almost 3 years and now the NY Regional giving RFE,
this is not good
you know laws are changing now, we dont know what is happening to our future.

Many friends of mine got RFE in NJ when there cases moved to DOL, just to confrim the salary and status before the approval, its nothing to be worry about, just another month of delay , which we got used too, best luck!
 
one of my friend got RFE, his case moved to NY Regional on March 5th. after 3 yrs waiting................RFEs.................(hope not rejections)
 
I just called 212-337-2193. For my company, there are two new cases (programmer analyst) moved to regional office on Apr 15. There is one other case (moved to regional office in Feb) got certified on Apr 21. But this one is not an IT related job.

It seems things are moving slowly. Such a painful waiting...
 
Backlog Reduction Centers

Latest news...

As you all are aware RFPs for Backlog Reduction Centers were sent out last September and were due back December 2003.

The latest is that DOL is giving the offerors one last chance to replace any of their key personnel and to then submit a list of people attending the oral presentations. The due date for the offerors is April 30, 2004.

I assume that oral presentations will happen soon after that (during May) and an offeror will be selected after that.

So if I were to guess at this point, I would say that a contractor will be selected by the end of May (earliest). They would have 60 days to begin processing - August 1st.

Now assuming that October 1st PERM is operational. I am guessing they really won't start backlog reduction centers until that date - as speculated before.

Since the NY SWA will STILL be responsible for a portion of PERM and they will need to turnaround very fast to meet the 21 day deadline - I am venturing to guess that ALL cases for ALL states will be transferred to the the backlog reduction centers after September 2004.

Now I'm really reaching - but I guess that the backlog centers will process by receipt date, which means they will do NY at the beginning along with some other highly backlogged states.

I am also sorry to say that if your case has not been processed by September 2004 - AND THIS IS ME SAYING IT AND IT IS COMPLETELY A GUESS SO DON'T FREAK OUT - that all those people from other states who were getting their LCs in a few months will have to wait for a longer period of time. Then again they could refile under PERM.

I have been reading this forum for last few weeks.
Please add me to the tracker...
labor applied on aug 30, 2001 EB2 RIR from NY.
No news yet, also don't have any proof. A bit nervous.

Also i have a few questions...
1.) My birth certtificate has been issued long after my date of birth ( ~15 years after). The handwriting is worst, my fathers initials are there but not his fullname, there are lots of scribblings etc and Most important my lsatname has a typo, eventhough its pronounciation is same, there is a single letter instead of double..example "mennon" and messed up one is "menon"..
I know that i have to get an affidavit and i have two from my parents, But they are almost 2 years old and they are on a plain paper with all details and notarized in US.
Q1.1) Is my affidavit valid?
Q1.2) Can i include both - birthcertificate and 2 affidavits.
2.) My I140/I485 will be applied from VSC.
Want to know anticipated/expected/guess for processing time for
2.1) CP - I40 processing and then CP date..etc etc.
2.2.) Concurrent processing...I140 and I485?

I saw, VSC has aug 2002 for I140 for EB2? But again, I think people got their I140 and I485 cleared even they filed after aug 2002...Any comments?

it is a matter of management

hi,

we don't know yet how the backlog reuction centers will manage the cases. for this managment u can have different scenarios.

for example they can say ok one of the two backlog centers will just deal with the states with very big backlog alone. and the second one will deal with the other states (with medium to low backlog)

2nd scenario: several employees in each reduction center will be dedicated just to work on cases of a specific state, so therefore u can have in each backlog center on average up to 25 groups to deal with each state or a combination.

so those are examples of different scenarios to deal witht he backlog. this means that it is not necessery that people for not crowded state have to wait for other in a crowded one. not necessary at all, it is all a matter of managment. let's wait and c.

it's actually a matter of interpretation of law - law "dictates processing by date of receipt"
 
how to search by employer tax ID.

In the AVM(212-337-2193), the options for Permanent application either requires Case Indentification or Employer phone number, there is no options for TAX ID.

some good news....I think...

another batch moved from state to regional

They've upodated the AVM(212-337-2193) and my case has finally moved to the regional on April 28th

I applied sept 3, 2001 RIR

I was doing some thinking...

labor cert in NY is taking 32-36 months plus another 6 months before that for RIR work a total of 42 months

then we move onto I140 & I485 where they're only processing Aug 2002 which is 22 months and if they only prgress 9 months in a year it would take us almost 30 months to get approval and then another 3-4 months to actaully get the green card
that's a total of 34 months and 42 in labor is over 6 years to get a green card in New York....crazy hey?

yes., really good news...at the end of month we are hearing movement of sept cases..
 
nyc1999 - would also be great if you can tell us if it was RIR/non-RIR and EB?

From my observation, they seem to do two batches per month. I know there was a batch on Mar 26 and there was another one on Apr 15. Now there is one on Apr 28.
