Good news. Thanks for the update UND77. I've been looking at their website.. and no update there.. Honestly I was doing wishful thinking and expected it to jump to August 2001. We'll see....

AVM @212-621-9330 is still saying as of Feb 2004....June 2001..

same song ........
 
LC rec'd by Regional on 3/10, AVM says 4/7

Just FYI - even though my lawyer received a notification that my LC had moved to the Regional Office on March 10th, the AVM states that my case was rec'd AND entered into their system on April 7th. Similar cases out there? Or mine was just a fluke?

PD: August 7, 2001
Rec'd by regional: March 10th (we thought) - AVM indicates April 7th.
 
it might mean that your case got approved by March 10th but moved to the DOL on April 7th , which match the theory of moving files on batches to the reigonal DOL.

Just a guessing
 
a naive question for guys:

Some guys are happy their application are clear from NY DOL, while other has no idea whether their file have been forward to US DOL.

The question is:

does NY dol give notice for each case that are clear at state level and forward to regional?

Hi all,

I have been watching this group for more than a year, crossing my fingers and pushing. Just a history to share....

My 6 year H1B visa expired on April 7, my company applied for an extension in December 2003 (1 year extension since I am in the Green Card Process - Feb 2002 Priority date), they paid premium for the extension (I do not understand why), but at the end I got the approval.

What a surprise. The H1B extension is only until November this year. I asked my layer why just 7 months extension??

This is my layer answer.

"I actually spoke with one of the senior supervisors at Vermont - he told me that he agreed with my position but his hands are tied by headquarters."

This is even worst since now, everytime I got an extension, my passport and extension needs to be send to Washington to stamp the visa since going to my country and doing it there take at least a month and my company doesn't like that.

Anyway, this is becoming a nightmare; this is going to be a yearly process, best case scenario.

So now, my company already applied for the next extension November to … I do not know yet....

I hate this situation...

I can totally relate to your situation. Mine is about to be 6 years in December, and I am about be shoved into same situation as yours. Add onto that the time it takes to get the stamping done. So, I would be literally a prioner to the paper work and bureaucracy of 'what-ever-the dept-is-called-now'

But then hopefully, EAD will come in 6-9 months (my PD is Dec 2001) and it will ease a little, but I hate it from the core of my heart.

Foreign Labor Certification Processing Times and Dates are not updated till now. usually they update every month 12th. this time not!!!

it has really been more between the 10th-20th of every month.
 
question about PERM

does anybody know if PERM would only affect LC, i.e no impact on I140 and I485 ? My LC was filed on oct 2001 and if (big IF...) everything goes well, I expect to receive an answer by the end of this year. I'm just trying to figure out if it's gonna take forever to go through the next couple of steps or if the implementation of PERM (which is also expected by year end) would make all our lives easier after the LC step..

No PERM only replaces the LC step.

However,

VSC made very decent progress in the last 15-20 days - actually processing about 90-100 days. I doubt they will keep it up but even if it is half of this, we could return to the days of less than 6 months to get I-140.

The I-485 front is not promising at all. Still very slow. Our only hope here is:

- There is a pilot at CSC were they are going to process concurrent I-140/I-485 in 90 days. Hopefully this will one day get rolled out to the other service centers.

- I am considering, doing I-140 and then consular processing - which I believe will reduce my wait to green card by about a year. However this may not be a good strategy for everybody.
 
6 year limit

The 6 year limit is the total time that you can be in US whether you are in L1 or H1. I got converted from L1 to H1 and hence I know this for sure.

Even if you convert from h4 to h1..
the total 6yr time limit applicable to h4 time+h1 time

Right??
