NY Regional DOL is processing cases (IT cases) received by April 7th/8th 2004.

Most of the IT cases filed under DOT code of 030-062-010 (software engineer) are getting RIR Denied.

If you're worried I think you look at you RIR application, if your lawyer did their job properly and put together a good case you shouldn't have a problem.

If your RIR get's denied you have to do regular processing but you keep your priority date, so it's not like you have to start over again.

Hi, My case was transferred on April 7th, 2004 applied in Jun-2001 with DOT code of 030-162-014. NOF is issued on case. Attorney hasn't received it.

Can anyone tell, what NOF is all about ?

I was doing research and sharing my findings with everyone in this forum.
I apologise, if anyone is hurt with my messages.

I notice some of IT cases got approved within 2 weeks of receipt date and some cases took more than 3 months to process.
Could not understand whats going on with NY DOL?

I agree some of RIR application may have not filed properly but if you noticed most of cases with DOT code of 030.062.010 (Software engineers) are getting rejected. Also status of these case were updated on 7/12/2004.

your correct that now NY Regional people are giving NOFs for almost 90 percent of the cases
my collegue got his labor approved on may ist week
but i got query becoz my case filed on sept 1st week.
so now many people are getting RFE's or NOF's
i dont know why those NY Regional people are sending now
they have to think before giving those queries, we worked all the time and in legal status and now if we have like this queries then what's our future

my company policy is if we get any query at labor they layoff, i dont know about my future man, i already in 7th year
tension mounts day by day.
only God has to help me.Please GOD

Also I will suggest users of this forum if they can share more information on their cases like reason of RFE/NOF.

Now I'am at the end of 7th year extension if there is a denial of my labor,
1. Do they do my 8th year H1 extension and also will my case be put into the regular process keeping the same PD
2.If i get the 8th year extension and put in regular process keeping the PD (Oct 2001) same... Since the processing date for regular is now in 2001 jan,will my application be picked up in abt 8-9 months ( consider if it moves month by month)

1. If RIR is denied then your case will moved to regular processing. Your processing date will be the date when your original labor was filed.
In your case it will be OCT 2001

If labor is rejected then you have to file it again. pain in the neck.

2. Yes. You should get 8th year extension if your labor application is pending with NY State or NY DOL.

FYI, NY STATE is processing NON-RIR applications received on April 2001

Yes. That is me.

While checking NY Regional AVM today heard the good news.
Two cases of my company had moved to NY Regional on April 20th and 21st, 2004. April 20th case got approval on July 7th.
Hope this is mine.

Yes. That was my case. Got approval on July 7th.
Took little less than 3 years. NY SESA rcd date was July 23rd 2001.
