You can't get case no. because they don't have it. EB2/EB3 does not get assigned at labor level (that gets assigned at I-140). I don't believe the DOT code is in the form either (not sure about this - I couldn't find it).

You can ask if it was RIR or not.

I would not worry about the IT "denials" people are talking about for two reasons:

1 - some are still getting approved so it's still case specific and not an across the board measure

2 - Your labor cert is most likely 2 years away from getting processed and who knows what the situation will be like at that point.

Guys, Please suggest me if I should consider changing attorney as I don't want my current attorney to screw this up. The letter also asks for the result of the posting.

Please tell me should I look for Pattern of Posting ?.

July 20, 2004 the U.S. Department of Labor issued an advance copy of the long-awaited labor certification backlog reduction regulation. Expected to be published in the Federal Register on July 21, 2004, the regulation should be effective August 21, 2004, 30 days from publication. Changes will allow for the transfer of pending labor certification cases to centralized processing center/s to clear significant backlogs in labor certification cases.
 
Looks like my company lawyer received a RFE for a October case in mid-June. Does that mean they were already looking into Oct cases in June ? Lawyer also said that they are receiving a lot of RFEs(nothing new about it).

Do you know whaeather it is from NYSESA or NY Regional DOL?
of course it should be from NYSESA!!! as we know NY DOL is processing APRIL cases... RIGHT!!!

I think it is NYDOL b'cos the lawyer said that one of the cases has been approved pretty fast after they replied the RFE. It also seems that NYDOL takes its own sweet time in working over RFE replies.

If your case as in tracker was filed on Oct, 25 2004, and got the RFE in Mid June , does that mean they are looking at mid Oct to Nov cases now, my case in Nov 13 which is very close?

once lawyer replied back RFE from NYDOL,how many days NYDOL people took to send to Regional and then within how many days they approved labor
can you ask your lawyer

i am also in the same boat and i cant talk to my attorney now as per our company rules

Is it your case that got RFE... that is filed on Oct 25th,2001 at NYSESA?

gc9s, It is not my case but some other case that was filed in Oct, 2001.

Verant123, I asked them the same question you are having. The lawyer said that it depends on the officer who is handling the case. That was the quickest response example. In some cases, it might take pretty long time.

From my discussion with my lawyer, i believe more in the theory earlier discussed in this form about technical cases handled differently. I think officers are assigned based on the DOT codes. some of them are strict and them some of them are cool ones.

Hope we all get a cool officer :))

Regional has got stuck at april 2004 for last few months...When is it expected to move to May? any comments...Please.
