They sent the reply on 5/23/04 and the officer denied to open my case as the reply was received very late.
As per my attorney he will do an appeal and he is also asking me to file the labor again. I do not know what to do. I am looking for another company in some other state where the labor processing is fast.

why i dont know these days NY State DOL and regional are sending lot of NOF's ..what's happening
those people didnt send any NOF's or RFE's for 245(i) people but they are sending to H1 holders like us eventhough we are paying lot of taxes and everything
this is inhumane..

Actually the denial rate for 245(i) cases was twice as high as that of regular cases. Also 245(i) cases are those with immigration violations but in many cases they hold regular jobs and pay taxes like everyone else.

45 day letters are sent from State (I don't think they are called RFE - this is the term used by USCIS not DOL) - These letters ask for clarification on things such as wage, job titles and experience.
The difference between the two is that NOF is determination of a case and letters are requests for information so they can make a determination on your case.

I am sorry to hear about your NOF. An NOF means your case been denied. However, your employer has the opportunity to appeal the case. Once they send the appeal, your case will either be approved or denied again. Your employer has a second chance to appeal again. After that your case will be approved or denied. No idea on how long this process takes.

I don't think yours is an NOF but a letter requesting clarification or your wage not being adequate (although other reasons exist for getting letter from NY SWA)

Go to page page 20 (or 21 Adobe's count). There is a process flow there. As I understand it, if you get NOF and do nothing, no other denial letter comes from NY DOL.
