Q) Can a CompanyA apply for 7th yr extension when another CompanyB has applied for my GC? Note: CompanyA has not applied for my GC but they hold my H1.

If the LC is pending for more than 365 days from one company, any other company can apply for 7th year extension based on the pending LC.

Q: My employment-based I-485 has been pending for a while. My H-1B is still valid, but I filed and obtained EAD and Advance Parole. Do you think I am no longer in a H-1B nonimmigrant status?

A: Your H-1B nonimmigrant status is not affected by applying for and obtaining an EAD and Advance Parole. It is the "use" of the EAD or Advance Parole that takes away your H-1B status. How do I know I used the EAD? You use the EAD in one of two contexts. One is that you use EAD with the same employer (H-1B) and your employer amends the form I-9 to change the employment authorization basis from H-1B to EAD for your payroll record, which you sign. The other situation is you use the EAD to work for a second or third job outside of the H-1B employment. In that case, even if you did not change the record of I-9 with your H-B employer, you lose your H-1B status. Once you lose your H-1B status, unless you leave and return with a new visa or a new H-1B I-94, you cannot reinstate the H-1B status. Again possession of the EAD and Advance Parole may be very important as a back-up when the situation changes, but until you use it, you will continue the H-1B nonimmigrant status. Drawback of working on EAD rather than H-1B is that you fall completely out of status when I-485 is denied, but such disadvantage is sometimes offset by disadvantages that comes with the continuing H-1B employment with the violation of Labor Condition Application or H-1B regulation, for instance, wages or locations, etc.

ISnt it 60-90 days prior to H1 expires as per PERM rules?? or it still should be 365 days prior to H1 expires ??

Since your wife used the EAD she lost her H4 status. So you are applying I-539 not for extension of status but change of status from Pending AOS to H4. Are you mentioning that on your I-539 application? You need to mention her current status as Pending AOS.
If you are not mentioning that It would cause lying under oath.

Other one is she is out of status since the day your I-485 is denied. If this status thing goes for more then 180 days she will be subjected three years of bar at least and if you apply I-485 without status it is deniable.

It should be filed 365 days prior to 6th year on H1 expires.

It indicates that even if it was used for some one else that was revoked properly.

Many thanks Tammy for your input - we are almost on the same page; I asked my attorney to pick up the choice of Change in status in I539 and then in the subsequent section in part 3 of 539, ask for extension up to the date of validity of my H1... I think once I do that with in 45 - 60 days of denial I should be ok. Then when she goes to India later next yr I will have her stamping done in India and a new I94. Pls advise - am I on correct path?

From what status she is applying for change of status?

From where did you learn 45-60 days time period is okay? There is no grace period once you are out-of-status. however under 245(k) any illegal stay less than 180 days should be forgiven by USCIS.

Why don't you choose to go to canada and come back with valid I-94, which is much simpler than filing change of status I-539 and getting new visa stamp etc. Also, I believe to be eligible to file I-539, one needs to be on non-immigrant status (out-of-status or EAD doesn't fall in this criteria). double check with your lawyer.

Your I-485 application is already denied. You are applying COS while she is out of status. when she goes to India next year she may have problems in re-entering US. Do you know the denial date of I-485

This may cause serious consiquence of 3/10 year bars

If you had a valid H1B all along, her use of EAD does not change/void her H4. So she is not out of status even if I-485 was denied (given that you had valid H1 when I-485 denied)

What i obeserved is,whoever going for i/v at this officer counter,officer talking loudly and our desi people also fighting with officer with loud voice.But,finally he is approving cases.He is not rejecting.

Jesus, this is scary. I am going soon for my stamping.

From where you got the info that use of EAD does not change/void H4.
 
Very Important for all CST UN,tammy please advise:

I saw a LUD on my already approved Cybersoftecs I 129(H1 visa)
Can others in the team also check if they are seeing LUD's on their CST

Is this a indication that INS is trying to revoke CST H1?

P.S. I have already applied for h1 transfer and have a receipt

Please advice.. asap.
 
d20910, when was your h1 approved. no change in mine. is you current application normal or premium processing.
