Can someone help me figure out what SWA are doing for 3 months. For eg. NJ SWA is still transferring cases to BEC. Within 3 month, you can move whole city and these stupid ppl couldn't even transfer pieces of papers. Why in the world they have to reenter (data entry) the cases if they already did at SWA.

How about we all start calling SWA directly and ask them whats going on.

We can atleast gripe about all these to our lawyers. They inturn will check with SWA and DOL.

We can also have full page ad in New York Times, Washington times and LA times. I am not sure about cost. If its costly, we can raise more money. I am sure everybody can spare couple of hundreds for this cause. I am sure this approach is fastest way to raise some awareness.

Does any one have any clue how long does it takes to through NY?


There is a posting says (means) the NY processing OCT'04

Hi based on what I have read on this forum, it looks like it takes NY an average of 3 months to put it in their system and another 3 months after that to approve it. This is truly based on what I have read on these forums.
I have also ready of case, which is still pending more than 6 months, sine it was transferred to NY DOL.

1. Your casenumber: (just let me know first 6 digits and omit last 2)
2. what is your dot code? ( Are you in IT field?)
3. which state you applied? Is it in NJ or NY?
4. when (exact date received in NYDOL) it is entered in DOL phone system?

I am sure with above information nobody will do harm to your case. This will halp me and others to track about cases which is very near to you. Thanks in advace for your information. All the best for your next stages.
 
I think this reduction in Budget is for USCIS processing their "so called backlogs". It does not mention DOL budget, this should be seen for BEC funding from DOL point of view. These are two entirely different departments, hence have different budget heads, hence should not be tied as the same. There was a memo out last year specifying about budget allocation for SWA's and BEC's for 2005 in the DOL 2005 transistion guidelines. Does anyone see a change in funding for BEC's under the DOL budget allocations....if this is true (budget reductions for BEC), then it is totally contrary to the aims of DOL's purpose of backlog elimination.

One Update

I have an update. My labor is cleared. Here is my details

Filed on 4/2002 in NJ RIR as EB3
Cleared by NJ in 8/04. Case moved to NY DOL in 8/4.
Entered in NY system in 10/04.
RFE in 12/24 and response given in 1/05.
Labor certified on 2/05.

I can now file only I-140. Lawyer told next month the date for filing 485 (EB3) will be March 2002. So I need to wait hopefully 2 months for filing 485.
 
working on Saturdays too

According to the details given by SWAS, seems like DOL has certified his case on a Saturday.

Hope they work on both Saturday and Sunday and clear all our cases.

Oh yes, they do work 24X7, 365 days in a normal year, 366 in a leap. We will all get our LC/485/140 in a jiffy!

NJ Status

Sorry to go off the topic.
But I cannot understand how long will ittake in my case. Everyday there is some new change.

My PD: Feb'04
My LC was filed in NJ in RIR.

As per earlier, I believe my application is definitely going to end up in BEC.
My Questions are:
1) is my application still sitting in NJ DOL? If yes, when can I expect it to move to BEC?
2) If its in BEC, has it been entered into the system or not?

Can anyone give a rough estimate as to how long it might take before BEC starts clearing cases?

Answer to this

When I meants 2/05 it is Feb 2005. It is not Saturday.

Now my case no starts with 025xxxxx. Dot code starts with 030. Filed in NJ as RIR. EB3. Lawyer told me it was approved by NJ in Aug 2004 but the NY system says 10/04(Oct). I am happy that at least I can file I140 now.
