You're correct.
It is usual that BCIS follow "priority date". Before concurrent filing, INS used to set priority date at the "I140" level and applicant can file I485 as soon as the visa number is available for their priority date.
Now all EB category is current, and at the same time concurrent filing is available. So the only method to set the priority is to set at the "Labor level".
Either we could add our priority date of labor in Excell sheet or just we could gather information from Aug-Sep files, and let's see how it goes.

As a matter of fact, the visa bulletin mentions that all cases of EB2, EB3 and EB4 as "C" meaning "numbers are available for all qualified applicants".
So, does that mean the ND of I140 is all that matters or the labor appln date by employer!
