You're correct.

It is usual that BCIS follow "priority date". Before concurrent filing, INS used to set priority date at the "I140" level and applicant can file I485 as soon as the visa number is available for their priority date.

Now all EB category is current, and at the same time concurrent filing is available. So the only method to set the priority is to set at the "Labor level".

Either we could add our priority date of labor in Excell sheet or just we could gather information from Aug-Sep files, and let's see how it goes.

So, does that mean the ND of I140 is all that matters or the labor appln date by employer!

streddy,based on that info, it seems like the PD would be the PD for the labor cert. cases. For example,people from MI might get their I-140 approved faster as compared to people from IL or WI, etc. Labor times in MI are currently 18 months..and hence, the I-140 for these applicants might be just 2 months, and thats why we have been seeing 2 month approvals for a lot of cases - we should find out if they are from MI or not.

I am waiting for my I-140 EB Nebraska concurrent filled RD 07/08/2003
ND 07/09/2003

I got my labor certification approved in April-2003 from Columbus,OHio

Please help to provide when will I get My I-140 Approved
 
Well, here's what - a friend of mine had applied for 140, ND 09/27 got his 140 cleared a few days back. My ND is 09/16, still waiting.

Here's the case for labor - my labor was filed in Feb 2003, approved in early Aug 2003 from IL. His labor was filed in Apr 2003, approved in early Sept 2003 also from IL. I know of another case similar to this with similar dates, got 140 approval in Jan.

The only saving grace is that there have been a bunch of approvals for late Aug (going by the postings on this forum) - hopefully, Sept cases should be approved soon.

Another positive issue is that none of the Sept 16th cases have been approved - niether RFE or approval (atleast I have not seen them on any lists floating around), hopefully, someone is waiting for an auspicious day to start looking at all the Sept 16th files.

We can all become scientists in probability and statistics by the time the 140 gets approved. ;)

Immigration Theories

There is no rationale solution to various theories that people take time to think/prove.Only thing that can be guranteed is the bureaucracy and its randomness. The concept of priority dates based on labor filing was before 2000 when it was impossible to file I140/ I485 together etc and every country had a specific quotas. Sorry to say but one has to just deal the randomness of the whole process.There are no clear and concise rules and its always upto interpretation. So chill and hopefully get through without a whole lot of damage .

you may be right astreix, but the info i posted was from the Nov 2003 document issued by the USCIS, not before 2000.
But browsing through labor threads/forums of other states with long processing times, NY,NJ,MI..etc - all the people here have been getting their I-140's processed within 1-2 months..as per the IL people bee_bee, well a couple of weeks here and there might be just plain luck or based on the company,category, job..thats my guess
 
Yes, I do believe it is luck more than anything else. My friend category was EB3, mine is EB2. My company is much larger than his - more profits also than his.

To borrow the phrase from Asterix, accept it as a part of the bureaucracy and be happy if we get out without and major damage. There is very little we can do other than grin and bear....

interestingly,, last week was the highest flood of approvals I have seen in my scanner's life.. I hope they stopped all the stupid approvals uptil march 2004 and hope they are now moving in sequential order... Here is the pattern of approvals

Out of 134 cases, 88 Approvals (66%) and 46 REF (34%).

Is not it alarming?:confused:

But good thing is that they are doing something.

I was very surprised to see my approval. Surprised becoz I had lost all hopes.

Their were 5 Approvals today in all for Sept 18th (Highest number of approval on any day for Sept 18th)

Hi,

I have got the following RFE on my case and I need your suggestions on how to reply this RFE.

Item # 14 on LC :
College Degree Reqd: Bachelor of Engineering Degree.
Major Fied of Study: Computer Science.

I am Bachelor of Engg in Electronics and Communication Engg degree holder. All the Advertisements specified Bachelors with Electronics or Computer Science. Somehow, we messed up the ETA (It's mostly my attorney, but I verified it also, so no finger pointing here).

This is what my attorney tells me even today.. We did not specify Bachelor of Engg degree in Computer Science. We required "Bachelors Degree in Engg..). The Major field of study is more for the courses I took rather than the Degree title itself. Now, I am not if she is right or it is just that she does not understand it completely or she just want to make be feel better.

The Educational Equivalency also mentioned that Electronics is very closely related to Computer Science field. The Officer even mentioned this and felt that there is NO provision in the LC for "Closely Related" field.

Apart from this, the RFE also included couple of other things.. my latest W-2, company's latest Fed Tax returns etc.., but there is no problem with them. We have them and we will submit them.

I am really worried about the Educational Requirements. Now, I just don't know what is the best way to approach this query.

I think nothing to worry at this point and Your attorney is correct.

LTA does not say "B.E in Computer Science Or Engineering", It says "Bachelor of Engineering Degree" and you have B.E.

Major Field of Study is O.K. I am sure you would have taken some computer papers in your B.E. Just highlight those papers to prove that your had completed Computer Science papers.
