I-140 Denied

I received a letter saying that my I-485 is denied based on I-140 denial. (My lawyer didn't receive the I-140 denial letter yet)

1.How many days i have to leave the country?
2.Does anyone have an idea on the validity of H visa, Is H1 six years and h4 six years or H1 + H4 Six years?

would appreciate any help regarding this.

What is the reason for your I-140 denial. It would be really helpful. Did you get a RFE before denail, if you did what was that. Shall be thankful if you share some of youir experience here.

Sorry to hear about your denial and I know how painful this is.

As far as I know,
1. You have 10 days to leave this country, if you don't have valid H1 status.(Or H4 status)
2. Total H visa validity is Six years. (H1+H4)

What is the size of your company? Looks like they showed loss in their Tax return last year. Can you please confirm this??

sorry to hear about your denial. I am little nervous becoz my RFE is similar and my attorney answered it in Feb. There is no update since Feb04 '04. Delay in decision leads to denial????

Can you please let us know about your company and your case details, that may help many of us to be proactive. My company employs not more than 20 consultant and revenues not greater than 1M and they showed loss last year, not sure about this year. Also mine is LC substitution case and filed for future employement. I mean I'm not on their payroll yet.
GINNU, Naanshi, Peterb any comments on possibility of getting approval.

CAn you let us know about your company's details, I mean number of employees, revenues, profit loss, it may help to guage about the chances to get approval or denial

Did you get RFE only for company Financials Or for some thing else also? Like education or Experience letter etc.
As per my experience, if the details you have posted are correct, then you should not have got denial.

Can you clarify this? It will be helpful for other people also. And also give me some more information like

1. Size of your company?
2. Year Established?

Peterb, sorry to hear about your 140 denial.

I responsed my RFE on Dec.19 2003 for company's ability to pay (which is the same as you), but I still don't hear anything from BCIS. :( .Now I am really worry about my case.:(
 
One more approved

Hi all,

my I-140 was approved yesterday, it came up on the online status today!!

Details are -

RD- 09/10/2003
ND-09/16/2003

My labour was filed in Feb end and was approved in Apr 2003.

Hopefully, we should see more Sept approvals! Relieved at last.
 
Reason for Rfe: Only Company financials.
Size : 20 employees
Four year old company.

Previously applied I - 140's got approved. two month before one I-140 got denied on same grounds(priority date 2002).



No update on online status check.
 
peterb, sorry to know that your case hase been denied.. Do you need have H1 to continue ?

If you are willing to change employer for GC, let me know..
