Nebrasaka I-140 Excel Scanner ..

Hope for the best. When things are not under our control, this attitude is the best.

One of my friend did the same thing an year ago - changed the employer before the 140 gets approved. Later he got his approval without any RFE, followed by 485 approval (even without any need of AC21). He was very lucky when he went to the local office for 485 stamping in the passport, he was asked, if he was with the same employer. This guy was about to say no, but somehow he said yes, and his passport was stamped without any further questions.

Yes, I do have EAD and I know that it is a great risk that I am not going for 7th year extension. I have to change the Employer using AC21 and the employer's attorney does not know basics of Immigration. I don't know how these fellow got his degree and working as "immigration" Attorney.

Bottom line is I am not interested in staying here also. I am ready to go back to my country. So I am listening whatever this dumb fellow says.

Knowingly I am going to do two stupid things.

1. Going to change Employer before I-140 approval.
2. Not going for 7th year extension.

If I don't get my approval (only Approval, not RFE) before this month end (which is almost impossible), I will be packing my bag and keep it ready.

I think I am helping some folks here by sharing my experience , but I am not able to help myself.

Y don't you post pone change employer? that will hepl u lot.

Is there any issue with present employer ?

As per my knowledge, earlier u did not get 140 approval from TSC. But this time I hope it will go smooth from NSC.

I run the scan on 04-100 from excel. The interesting thing is one case is apoproved which is filed on 02/25/2004.

One case from 09/10/2003 updated and that to with REF

Ran the scanner for I140 cases from 09/10/2003 (approximately 28 cases). One is updated and that too with REF.

No Change in the status of the 09/10/2003.

I believe they are still in the hangover of St. Patric's Day boozing.

5 out of 7 cases had ref's in the scan list pasted by jaiganesh, do you think they are sending more ref's theses days or is it just a co-incidence. I think my LIN and jaiganesh's LIN are very close to the numbers who got REF's. Hope they dont any ref's to us or as matter of fact to none of us.
 
one case on 09/14 had a RFE of the 09/13-09/16 cases I am tracking. There is no status update for the other cases. Wonder how they process the cases - at random ??

I think this week we have seen a flood of approvals for last 2 weeks of august, and people who are doing scanning should be able to see a sequential approvals from now on..

As my case has been approved and I-140 currently getting processed is almost at the end of August, I won't be able to run the scanner and put any updates here..

See you all in I-485 forum.. I will from time-to-time visit this forum too..
 
Determining the priotrity date

this info might help to figure out why some people get their I-140 approved faster (say people from MI whose labor is longer than the other states in chicago region)

Determining the priotrity date: Under INA § 203(f), immigrant visas are available in the order in which the underlying visa
petition was filed. The “priority date” determines an alien’s “place in line.” For EB-1immigrants, the priority date is the date
the employer files the Form I-140 with USCIS. For EB-2 and EB-3 immigrants, the priority date is the date the employer
applies for the labor certification, if an individual labor certification is required. If an individual labor certification is not
required, the priority date is the date the employer files the Form I-140 with USCIS. If the alien is the beneficiary of more
than one Form I-140, the priority date for EACH Form I-140 is the priority date for the earliest Form I-140. For EB-4
Immigrants, Form I-360 is used instead of Form I-140. The priority date is the date of filing the Form I-360.
The Visa Office, U.S. Department of State, publishes for each month a Visa Bulletin, which specifies the priority date for each
immigrant visa classification. If an individual’s priority date is earlier than the priority date shown in the Visa Bulletin for the
particular immigrant visa classification, then an immigrant visa is available for the individual’s use. If the Visa Bulletin shows
the priority date as “C,” then an immigrant visa is available for all approved visa petition beneficiaries in that classification.

As a matter of fact, the visa bulletin mentions that all cases of EB2, EB3 and EB4 as "C" meaning "numbers are available for all qualified applicants".

So, does that mean the ND of I140 is all that matters or the labor appln date by employer!
