Just be patient and it seems as if the IO who conducted the second interview had no other cases except to grill you on your N400 application. If i were in your position, would drinik a relaxation tea, green tea dude and wait for them to do their thing. I think if they want to deny your case, they will deny it irrespective of the speed of the decision. Just find yourself a patience pill, many are available online. Congratulations on your newborn, I can see the summer didn't go to waste in your household...lol!!! The lawyers and everyone else here is right on this issue, you lost the right to a 1447 (b) lawsuit the moment you were interviewed for the second time, you need a new clock for the 120 day rule to file the lawsuit. I would wait and hope they approve your case before you are before a judge. Did you get beaten with a wooden spoon while in jail in Iran? I understand the jailers could be brutal there.

Is Iran really that bad when compared with other countries but excluding north American and Westen Europe?

Almost no other countries can beat Western countries by Western standard. But even by Western standard,
is Iran very bad among non-Western countries? Iran seem to have women lawmakers which manyh other
muslim countries do not have.

According to the document linked below, there have been several precedents where it was established that the 120 day clock starts with the initial interview. The fact that Armin78 was interviewed for a 2nd time does not restart the 120 day clock.

that's what i was told by one the best immigration lawyer in DC. he told me that he can file a 1447b from my first interview since the court consider the first interview as the initial review and also USCIS gave me "interview result letter" which in the eye of the court interview was conducted.
 
I'm no immigration lawyer, but I'm a fellow Persian, haha! I'm also in the process of immigration (just applied for my Green Card). Used to live in Canada, got sick of it, so America here I come.

Good luck with your application and all. Thing's will work out in the end.
 
What is sickening about Canada? I had hoped to live there for freebies when I want to be cheap...lol!!! I hear people there are extremely nice, own too many guys and still there's less crime there because most citizens are in bed by 6pm, government-manded curfew....lol!
 
I don't know about the curfew, but it could be because Canada's national culture is a little less violence and machismo oriented.

Reminds me of a movie called Sholay in India. There's a bad guy Gabbar Singh ... he is talking about his exploits and says that in the night when kids cry, the mother asks them not to by saying that if you do not be quiet, Gabbar will come.

Maybe the Canadian moms are doing something similar pointing to the Americans ... telling kids from an early age do you want to be like Americans ... and the ones who do not listen, anyway move to America.
 
As I read 1447(b) caluse, I found out this 1446(e). This post is not about OP's case and should be a new thread but it seems new post function break down at this time.

1446(e) says applicants can not withdraw applications once filed unless Attorney General (should be Secretary of DHS now) agree.
So even if someone withdraw N400 after filing, the USCIS has the right to interview him and grant his application? Of course it does not make sense because the applicant can just skip the interview, or refuse to sign Part 13 and Part 14, decline to take oath etc.

This is what it says:
After an application for naturalization has been filed with the Attorney General, the applicant shall not be permitted to withdraw his application, except with the consent of the Attorney General. In cases where the Attorney General does not consent to the withdrawal of the application, the application shall be determined on its merits and a final order determination made accordingly. In cases where the applicant fails to prosecute his application, the application shall be decided on the merits unless the Attorney General dismisses it for lack of prosecution.

I suppose it means that if you request a withdrawal, they can decline your withdrawal and put "denied for poor moral character" based on the available evidence instead of "withdrawn", so the denial will raise a red flag to the next IO if/when you reapply.
 
Exactly! Other than that, Canada is a beautiful country. Canadians are sickeningly nice too.

Why did not colonialist in Canada fight British ?

(1) because of low taxes
(2) Low taxes with representation
(3) British troops did not stay in their houses (no quarting or boarding)
(4) because they had self-government

I went to DO and asked about my case. they told me that my case is still with the IO who interviewed me and it may take up to six months for them to make a decision on my case.

It will still be there six YEARS from now if you don't file 1447(b).

Read between the lines... The person at the DO told you to file 1447(b).
 
I am ready to file a 1447b , but as i mentioned it before, couple of lawyers told me to wait 120 days from my second interview before i go to court. I know that there are several cases that the judge accept the first interview as an initial examination. I just don't want to waist my money. but i guess have to make a decision soon.

BTW : I do appreciate all the advises and guidance given to me on this forum.
