My 485 denied, help me please :(

I did con current filing for my I-140 and I-485 on Aug 2007, I got my EAD card with in 3 months, When I applied for my EAD and AP renewal this year, I got a denial notice from USCIS saying my I-485 is no longer pending but I checked the web site it says it is still pending, upon calling USCIS, they said wed site is not updated regularly. But my I-485 did get denied. But I never received I-485 denial notice nor RFE on that. I checked with my lawyer also on this, even he did not received any notice.
I am still on H-1 and I did not change my employer nor I used my EAD (I just took that as a back up). I am on 9th year h1 extension now. Please help me out here what to do next.

Please update us on your PD , country and reason why your 485 got rejected (if you have found this by now).

I really dont know, because I havent received any denial notice from USCIS. When I asked for the denial reason, they said they are going to resend the notice again to have a look. Even the web site says my case is pending, but when I call USCIS they say I-485 is denied.
 
What is the status of 140. Ask employer/lawyer to check on that. It may have been denied, hence 485 denial.

1. was your info like I-485 receipt number or A# correct on the forms you filed for EAD and AP? If filed by lawyer check the copy of forms.
2 .May be I-140 got denied. If I-140 got denied then I-485 denial notice should come to lawyer who filed I-485.if you have I-140 filing receipt number then see the online status.
3 .online status may be wrong and it is not always correct.
4. take the infopass with local USCIS office and request them to check your I-485 status (take your I-485 filing receipt)
5. if I-485 was field by lawyer then he can write letter to USCIS and can get the update/status of your I-485.

hmm.... I attended infopass appointment today, I checked my I-485 status with them , they said it is denied. But I forgot to ask my I-140 status. But both status show pending when I see online. My only hope right now is ask my lawyer to apply for MTR (???)
 
I-485 returned

Hello,

I got approve for my I-360.
Then i sent the I-485, and the immigration send it back and say they can't accept I-485 form R visas right now.
my lower said she have another customer that she send it 3 times and they send it back.
they did not deny or reject the application they just send it back.

- any body now something about that?
- what can i do now?

Looks like my case is becoming more interesting than ever. I requested USCIS to resend my I-485 denial letter and I waited for 20 days, still I havent got any, then I called USCIS regarding this and I just asked for the content of the letter, it says "We can not re-send the denial letter as it is sent only once, I need to check with local postal service and my lawyer did not submitted G-28 form along with it so no copies to my lawyer also " , but I checked with my lawyer, he says they did submitted G-28 along with my file and in my I-485 receipt it clearly shows my lawyer name and address in it.
It looks like it is big mess. how to proceed from here

Looks like you are gonna have to fire that lawyer. Because he/she is a mess.
The lawyer said he sent the G-28 but never received paperwork. Sounds fishy to me.

You are working with same employer who filed your I-140 and you filed your I-485 with I-140. Your company hired lawyer and that lawyer sent form G28 with your I-485. If the lawyer has sent G28 with I-485 lawyer is supposed to get RFE or denial notice from USCIS. Lawyer office keeps the copy of each form filed for you and the lawyer office should have Copy of your complete file. Check your file G28 copy should be in the file or ask the Copy of G28 that was sent with your I-485. Lawyer was also supposed to send G28 signed by your employer with your I-140.
Did the lawyer change his office address AFTER filing your I-140 and I-485??

It seems your I-140 is denied. You should ask your lawyer and employer if I-140 is denied. Did USCIS send any RFE for I-140??

When you punch I-140 filing receipt number online status what status does it show??

* According to my lawyer, he did signed and sent G28 form, but I did not ask for the copy of it [may be my fault], but if I see my I-485 receipt it clearly shows my lawyer name and address

* Online status of both I-140 and I-485 says Case Received and Pending [you might be surprised how do I came to know that it was denied, actually I applied for AP and EAD this year and it got denied and the reason USCIS gave is I-485 no longer pending]

------------------ ask your lawyer to find out the status from USCIS. if he is AILA member he can get it faster.
***Did you use the LC substitution?

Request congressman to help

Request your local US congressman to find the status. Don't waste time waiting. MTR for a denial(if any) needs to be filed within 30 days(?). Lot of mistakes(not in our favor) happen at USCIS. All the best.
