misdemineor charge be dropped if i take a class?

my freind got charged with class A misdemineor of solicitation of prostitute, which was an entrapment by undercover famale cop.

have court date coming soon and the defense lawyer who sounds sensative on immigrant issue says, He can ask the judge for a class without pleaing guilty and later show the class completion letter to the judge to get it dismissed. He said it is no way any conviction or any supervision or probation and it is a dimissal of the case. he said later he can get it expunged off my record.
He also said it's not a plea deal.

is it really true? Is it really not any guilty plea deal?

what's your expereince or suggestions?

he got asylum and waiting for GC to arrive.
 
This sounds reasonable. I had the same case in California, but mine was for resisting arrest. The important thing is that you don't enter a plea. If you plead guilty or 'no contest' it is the same for USCIS.

In diversion programs, usually for first time offenders, you don't plea. You do the community hours and then the case is dismissed. My court papers say : Not Guilty - Case Dismissed (it actually says Plea NG - FINDING DISMISS). In the US that means INNOCENT, it's the American way, innocent until proven guilty (or confessed/didn't contest charges).

were you arrested once before that?

he got arrested once before for harrassment charge which was dismissed in court.
the dismmissal leter says STRICKEN OFF/ LEAVE REINSTATE.

can he still get what you call the diversion program?

be especially careful. The immigration law defines a guilty plea very broadly. Many people have fallen into this trap. Consult an immigration attorney or a criminal defense attorney who deals with immigrants frequently.
 
i was found not guilty of the crime of solicitation of prostitution because the famale undercover police who arrested me in the sting didn't show up at the court and therefore case dismissed.

I hired lawyer and agreed to pay cost of $1500 fee, i feel like i wish i hadn't hire lawyer as I didn't have to go to trial but thna whta if the cop shows up and judge sets a trial.
So there it was still worth hiring the lawyer.

Right now i wanan expunge the arrest record but i have to wait 120 days for the expungement?

so the arrest record won't hurt my future immigration benefits cos it got dismissed.

I thought it was your "freind" who got caught soliciting a prostitute?
 
i am acting as a spokesperson for my buddy.

should he be worried now after case being dismissed?

arrest record means nothing to USCIS if no conviction right?
