Yes, I did fax the request to the same # as you mentioned.
I faxed them my passport #, DOB, Country of Birth, and email id.

It seems it worked and passport is on its way.

Return address change..

Correction -

They did not change the return address. But of the confused persons in Visa office did confirm that they are shipping it to my new address.

Just confirmed from USPS that passport is being shipped to the original address.

Cant trust these guys at all.

mistake in visa

for info...my stamped visa has the wrong birth date on it (they screwed up the year). My lawyer suggested sending back all the paperworks (+ a birth certificate) to their corrections service (apparently they take only about 5 business days to get the job done). Will let you informed how it goes..

Problem with Form I-797, Please do advise

Hi,

Recently I received approval for my 7th Year extension. I am planning to revalidate my visa from St. Louis.

There is small problem on the Form: I-797. At the bottom of approval notice where they provide new I-94 card, somehow I-94 # is missing from both side (bottom left and right portion) of approval notice.

I spoke to my attorney on this issue and she advised me not to worry about it. She said

“This is a small glitch on their system but they have you properly documented, and the petition which we filed is also have you properly documented. Therefore it is unnecessary to re-apply requesting any correction.”

She also advised me to continue with my plan with revalidation.

Guys please advised me what I am supposed to do. In case if someone already had this issue.

This may or may not be problem. This could be a problem IF INS approved your H1 petition but did not provide u with new I-94 purposely. This means that after your current H1 expires you will have to leave the country and get H1 stamped from abroad consulate.
This may not be a problem if INS did approve your petition but by mistake did not include new I-94. In this case it may be difficult to prove to DOS that indeed ur I-94 was extended and it was a mistake on INS side.

One way to check this is , if u read the description on I797 it mentions that this persons status has been extended and person can work for petitioner. If something else is written then u may try to dig into it more . Prob call INS and confirm before sending any paperwork to DOS to St Louis.

Let me tell one more thing that they have provided the I-94 card (attached to Form I797 at the bottom) and even they have written correct/new validity date of left hand portion. Only thing they missed is that they didn't write any I-94 # on it.

What do you think?

ok.. I guess ur previous statement confused me. In that case I really dont know ..I mean you can give it a shot. OR make sure all description says that ur status has been extended and u can work for petitioner and blah blah..then prob call INS and confirm ur H1 does have a new I94. ..And then prob try sending it to St Louis.

Helped needed. I-485 filed during out of status

Hi all,
Thanks to all who responded my post first week of May.
Please give me your comments, suggestions, let me options available to us etc.

Here is the summary of the dates to make things look clearer. I did not know that my wife and my son needed to apply for H4 extension. We assumed that all dependents were automatically included with my H1B petition, which my employer had filed in July 2003.
Now I have several questions:

a) When I applied for the I-485 and I-765 for my wife and son, they were out of status. How does that affect our recently submitted petitions for the I-140, I-485 and I-765?
b) Are their petitions for I-485 and I-765 invalid, due to the fact that they were out of status at the time of filing the petitions?
c) What are the risks and issues involved here?
d) What is the best strategy to resolve the issue?
e) Are my wife and son out of status now?
f) Will there be the 3-year bar applicable to my wife and my son?

Note: There have been several errors from the immigration department: in the I-94, first they put me as an Indian citizen; my employer wrote back stating that I was an Australian citizen who was born in India. The immigration department sent us another I-94 with another mistake; this time putting me as an Austrian citizen. After writing again they finally got to the correct citizenship. The whole process is documented and I have the copies of all the letters. The process to correct the ‘citizenship’ mistake took several months. My employer is saying since it took so long and in the process of writing these letters back and forth she forgot to mention to me that I should apply for my family separately.

My passport is in print Q from last 5 weeks. Still no update. FEDEX has not been picked up. Did anyone face the same situation and how did u over come it.

There were a few posts which said that they have stopped giving any info at this number from last few weeks.
