MARCH 2004 Guys Please Update!!!!!
Hi Guys,

Look like USCIS is processing March Cases.Today we have got New JIT
The dates remains same for March 22 (I-140 Cases).For I-485 cases It is updated March 19th.

EB2
I-140/485 RD is 03/26/2004
EAD AP Approved
FP Done on 05/07/04
LUD changed only for 485 on 10/27/04
Still Waiting

Neither the I-140 nor the I-485 dates have changed since the last update on December 6.

EB2
I-140/I-485 RD: 03/12/04.
Spouse I-485 RD: 04/29/04.

I-485 LUD: 10/15/04
I-140 LUD: 12/14/04 (could be due to H-1 extension approved on 12/13).

140 RD March 2
485 RD March 2
11/07 RFE for 485
11/09 RFE for 140
12/07 RFE received by CSC
12/13 140 approved
485- still in the air

Yes you are right. The new dates have been put up but absolutely no changes for I-140/I-485. I am also waiting ...

Hi Guys,

I think processing has either slowed down because of holiday season or may be the number of cases are increasing. I am also still waiting.

Has anyone recently scanned for results of end of march prcessing?

Yeah, unfortunately, I think you're right. Things looked very encouraging for a while, but I think CSC is back to its old ways :(
 
My EB2 is also pending ....
BTW, why EB3 seems moving faster than EB2? I saw EB3-140 people from April-04 got approved.

I got the online status message changed to the following (RFE) this morning in uscis.gov

"On December 22, 2004, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed. If you have questions about the notice, what is required, or if 14 days have passed and you have not received the notice, please call the National Customer Service Center at (800) 375-5283."

This is for RD - March 26 ( EB3 )140

Lets see, what's going on. Will keep you posetd. Atleast happy that somethig happenned.

Guys, how do you findout if there was a LUD change for your case.
I only have the WAC numbers for my 140/485 and I usually key in them to findout the case status. Is there a different website from uscis.gov or am I missing something.

For my case, for the past 8 months, the status was showing something like "we have received your 140 on march 26 and we wiil let you know once the processing is complete". This got changed to a RFE this morning to the message I have pated earlier.

Will keep you guys posted as and when I get more info.

Thank you ok_almost_there for the link. I will keep you guys posted for enquiries, advise as and when I get more info. about the RFE. Being christamas time, I guess things will be a bit slower as most of the people will be on vacation.

Any March filers still waiting for their cases to be touched(with NO RFEs at all)? Seems like there are a lot of approvals for April filers.
 
Finally, I was able to get a copy of my RFE. This is what the RFE Says. My attorneys are planning to reply sometime in the month of february, once I get my 2004 W2's. I hope they do not screw up. Let's see how the things turn up. The notice says to reply by March 16.

Ability to Pay: Provide evidence of the petitioner’s ability to pay the benificiary’s wage. The petitioner must demonstrate this ability at the time the priority date is established and continuing until the beneficiary obtains lawful permanent residence. Evidence of this ability shall be either in the form of copies of annual reports, copies of completed & signed federal tax returns, or audited financial statements.

The petitioner is requested to provide this evidence for the years 2003 to the present.

Benificiary’s W-2 Form: Part B of the ETA-750 indicates that the beneficiary has been working for the company from October 2003 to present. Submit a copy of the benificiary’s W-2 form for the years 2003 to present.
 
Finally. my company attorney's replied to the RFE and it was received by USCIS on 2/7. As per the RFE, I had to only supply copies of my 2003/2004 W2's.
I saw a status message change on 2/7 as well as LUD. I also got the e-mails. For a moment I got worried as this was the first time, I was getting such ann e-mail.

Also I had LUD on 2/8 and 2/10, but no message change. Not sure if this is good or BAD. Will keep you guys posted as and when I get any more new info.

No LUD or No case status update

Almost I got the same type of RFE for my I-140 requesting W2 starting from my priority date to present ( 2002, 2003, 2004), and transcripts of all my education. Lawyer received the RFE on 26-Jan-2005 and I have mailed color copies of all requested documents on 29-Jan-2005, and my Lawyer received it on 31-Jan-2005. I have no idea when did my lawyer replied to CSC, and she said she will mail it in a day or two probably on 02-Feb-2005. But so far there is no update or No LUD change. Will it be taking more time to reach CSC or to update the case status?. Thanks.
