MARCH 2004 Guys Please UPDATE

Hi Mesbah

That's what we dont know yet.Why they are not approving 140.It is really bad.
They r holding 140 for the name check to clear.What is Name Check.How long it will take.Just some stupid reasons for not approving the cases and delaying the process.

Applied for my EAD renewal with March 15 RD. Got a letter for biometric data capture for myself for 3/30.

140 had a query that was responded on feb-7. there were luds on 2/7, 2/8 and 2/10. No changes for 485 or 140 since.

Guys, is there a pattern. Are everyone supposed to go through biometrics ? Does this have anything to do with Name check.

Anyway, will keep you guys posted about biometrics with my experinces.

There are actually 2 biometric phases now. The first is for EAD and second for the 485. I had the biometrics for my second EAD done 2 weeks ago and the biometrics for the 485 done today (even though the appointment was 4/7 I just showed up at the ASC with my family at the end of the day and got it done). IMHO, it should have all been done at the same time. Data should only be captured once! :confused:
 
I just got my FP notice too. It hasn't been even a year since my first one. Code 3, so I guess it's biometrics, and all FP.

I was just about to file for the second EAD and AP, does that mean I'm going to get another notice for more biometrics? This is a pain in the ass. It's not like my finger print is going to change overtime, or has changed since last year.

Could this be a good sign or is it automated? My 140 hasn't even been approved yet :(

Yes! I agree all this stuff should be just captured ONCE.

In my case, I was told my file was on an adjudicator's desk (my I-140 isn't approved either).

My guess is that they looked at the file and saw the biometrics were missing and ordered them. I suppose the adjudicator won't even look at the case again until a week or two after the official appointment date (even though I had them done yesterday).
 
Any idea why your 140 is not approved yet? Response to my last inquiry was (undergoing detailed review). Anyway, I'm guessing these adjudicators are waiting till the 485 is ready before approving both??

Sigh, 10 days, you are very lucky gca. I have been waiting 3 months since responding to my RFE (education and ability to pay - both bogus issues).

I have no idea what the problem could be mesbah. According to the emergency line it only hit the adjudicator's desk this month. Why would it take 2.5 months for an RFE to even hit someone's desk?

EAD Got Approved on April 25 and received the new EAD card yesterday. But, There is a RFE on my AP Renewal application. Not Sure what is it about.
I have also Applied for my 8th year H1b extension, in March, 05.

Can anyone who had RFE on AP let me know what it might be in regards to.

My 140/485 are still pending.

EB3 - concurrent(sub labor). 140/485 applied in March 04.

I applied for EAD/Ap renewal last week. However, I bet the RFE is about the pictures. If there was a problem, they would not have approved the EAD (they usually hold especially this one if they think the 140 needs an RFE or won't be approved).

Don't sweat it. They probably need better pictures! Keep us updated. Wow, I thought I was the only March 04 left.
 
Thanks a lot for the info. I guess, there are a lot of March 04 guys who are Fed-up by now waiting and are kind of staying Away for sometime.

I had an RFE on my AP and I don't know what it was with regards to however from the time my lawyer replied and I got the approval, it took approximately 3 month so be prepared for this. FYI

BTW, I can not believe that u guys are still waiting...did you write to your congressman? it might help

No news on my 3/04 case.

Just replied to another thread too.
EB3 non-concurrent, subs. labor (1999).
I140 RD/ND: 3/31/04. LUD 3/6/05. No RFE, no nothing.
Lawyer sent inquiry on 3/8/05. No answer yet.
Should I call them now or wait for 60 days after LUD date?

why haven't u filled 485? Ask the lawyer to call the emergency #. You should at least know what's holding up your case. Good luck. Does the retrogression affect u?

Because the company didn't allow it. They said it was not proven to
be effective yet, sigh! No retrogression does not affect me (I don't know
what it means but I am guessing it is something that would affect
Indians, Chinese, etc.).
 
485 is your own petition, not theirs. You can just do it without them even knowing about it. Search for stevphel who did it himself (he didn't even use a lawyer and got approved). All you need from them is to file your I-140.

Anyway, I have a couple of questions. If someone can answer, that will be really great.
Q1. As I had updated previously, there is a RFE on my AP Renewal. Though my EAD renewal is already approved and I have also received the new Card. Yet to know what is it about. But the question is, will it stop my 140/485 processing in anyway?

Q2. I have not done any serious enquiries so far as I had applied for my wife's 485 on Dec, 2004. Now, I see that they have started processing Dec'04 485 cases. So the question is, Is it possible that my 140/485 may be on hold becasue I had Added my wife's name in the application, which was applied at a later date.

On top of all of this, mine is labor-sub. There was a RFE on my 140 about company's ability to pay and they needed W2's from me for the years 2003, 2004. RFE was replied on feb 7 and after that there are no status Message chages. But there was an LUD as of 4/12 on both 140 and 485. May b because of EAD/AP renewal hat were filed in March, not sure about anything.

You are right Mesbah. The RFE on my Advanced parole is about better photographs. Stupid Walgreens lady or stupid me for not being more careful. I will go to a professional photographer this time. Funny thing, the same photographs were OK for the guys who are handling EAD renewals. Strange journey.
