MARCH 2004 Guys Please UPDATE

Just a quick question.
I called the 800 number a well as the CSC emegency number about my I140. But in both the places, they told me that for I140, the only persons that can initiate an enquiry are either someone from the company or the attorney of record.
Did you do any enquiries on your 140 by yourself or through your attorney?

They have received my RFE response on feb, 7 ( as per the website message) and there has been no activity on it till now almost 3 months.

Anyway, I am planning to call my company/attorney and would want to start somekind of an enquiry ASAP. Thanks for your valuable avdices.

The only way I was able to get someone from the emergency # to talk about the 140 was to inquire about the 485 first. Then they say, "oh, ur 140 is still pending. Do you have the receipt #?" I give them the # and then they look and give me information about it (when it was assigned to an officer, etc.). Every other time, I would nag my HR person to call them while I'm sitting in his office (on speakerphone), or nag the lawyer to fax/call/email Division XII about the 140.

Did your message change to "received RFE response"?? The lawyer and company should be able to call Division XII right away to get some status.

And yes, The message on my 140 does read RFE response received on Feb 7 7 .... blah blah blah.

As I had updated earlier, the RFE was about the company's ability to pay and W2' for Year 2003, 2004 from me.

I will try this technique and see if I can get some info. Also, Thanks for the DIVISION XII info.

Hi Guys,

Yesterday, I finally got a copy of my 485 receipt from my employer. All these days, I just had the receipt# and was doing a status check based on this on the USCIS website. After going through it, I saw a couple of things for which I have a small question. I would really appreciate if anyone who has the 485 receipt with them can confirm if it is OK.

On the right hand side it says
Notice Type : Receipt Notice
Amount Received : $ 305.00
Section : Other Basis for adjustment.

I am really woried about the word Other Basis for Adjustment. Mine was supposed to be Employment Based adjustment. I am not sure if this is a Employer/attorney screw up or this is something Common for everyone.

I would really appreciate if someone from us can confirm what does it say on their receipt notices. The reason I am asking this is because, I know a friend of mine whose 485 application went to the Political Asylum queue becasue of the attorney/USCIS screw up an I am really worried now if the same thing has happned for me also.

Although I don't know what it means, I checked my EB3 485 receipt and it states
"Adjustment as direct beneficiary of immigration petition"
and for my wife
"Derivative Adjustment"

I am attaching picture of this part
 
Thank you 140_485. For my wife, it does say Derivative Adjustment as yours. I think there is somekind of screw up in my case. I need to check with my Company/Attorney about it.

140_485, I guess yours looks its your own labor.

Any labor sub guys, do you know what does your 485 receipt say Next to the word Section ?

my 140/485 is also for labor subst filed in Dec 04
To me your case looks suspecious

Both mine and my wife's receipts specify "other basis for adjustment".

I dont think there's anything to worry about ---

I just checked our draft 485 forms. On page 1, Part 2, under "I am applying for an adjustment because", the box h "other basis of eligibilty" is checked. The explanation reads "I-1485/I-140 Concurrent Filing".

Thanks Montush. Thsi really gives me some hope. I guess, the whole process is so screwed up, everyday it looks like we find some reason to worry about. What would happen if we did not have this forum to clarify and get some peace of mindfrom this gruelling process.

I checked my 485 application and as montush had mentioned. on the first page, the other category is checked with concurrent 140 and 485 filing mentioned in the description. Thanks for the info, guys.

Let's see how things go from here. The patience is slowly running out.

Received my 8th year H1B/H4 approval notices for self/wife today from my employer. I hope, this is the last H1B.

March 31, 2004 RD, still waiting

LUD is 3/16/2005. Lawyer initiated 4 inquiries so far. No response.
I called the national customer service number and they told me the company
needs to call (or lawyer I guess). Asked lawyer to call but they probably
re-sent the 4th inquiry instead of calling them on phone.
No RFEs either. My guess is my EB3 subs labor is too old (sep. 1998) and
the 2 year employment prior to that date involved working abroad.
Not sure if they are not convinced or they simply forgot my case.

Anyway, orginally company didn't do concurrent filing, I pressed, and now
we are starting I-485.

I have a LUD on my 140 today. No message change though.
I hope this is a positive sign. Will keep you guys posted.

Finally got the magic e-mails this morning about I140 approval. I am still in shock. Almost waiting from march 24, 2004 and was really worried because mine was a sub-labor case and I did not know anything about the original labor.
I hope all you guys should also get your shocking e-mails about your approvals pretty soon.

Did you see your LUD change yesterday morning and was the LUD date 6/8 or 6/9. This morning, I saw that I also have an LUD update dated 6/9 but no message change. Hope the magic emails follow soon. Also, what about LUDs on your 485?

I had an LUD of 6/9. Kept checking my e-mail till 11PM central time every one hour to see if there was any magic. Went to bed disappointed and when I came to work this morning an checked my e-mail, there they were, the 2 2-mails.

the last LUD on my 483 is still 4/12/05, when they received my bio-metrics results. Hope, your LUD means the same magic for you also. Good luck
 
Just now, I see that there is an LUD of 6/10 against my 485 receipt#. No message change tough.
Not trying be too optimistic, maybe this is becasue of the enquiry i intiated on my 485 thru the 1-800 number.

Anyway, will keep you guys posted about it.
