Mine is sub labour. Rd/nd date 26th march. RFE on Oct 12th and replied on 4th jan 2005. No LUD till date except recieving the evidence on 6th jan 2005.....just keep hope on it

Also, I looked at immigrationwatch.com for recent I140 approvals from CSC. It looks like no case has been approved after 1/20/05.
Anyone from CSC whose 140 got approved after 1/20, please share your info. I hope CSC is not hibernating.

Have you received any RFEs at all? Any LUDs on your 140? Are you EB3? I like that idea. I think they usually take a look at the 140 application when you apply for EAD/AP, so you might have something there. I sent a request to my lawyer to start that ball rolling.

Below are my details:
EB2
140 (Substitute Labor) ND - March 24, 2004
485 ND - October 14, 2004 (LUD - 01/10/05)
Yesterday my lawyer called and talked to the USCIS officer. This is what he had to say: "My case is in the adjudication department and they are waiting for my original approved labor certificate to come from National Visa Center (NVC). Once they receive it, my case processing will continue."
I am not sure if the substitution labor triggered a request to NVC or if they request for everybody. And i also don't know when the request was made to NVC. Recently i had a LUD change on my I485 on Jan 10, 2004. Maybe that's when they might have sent the request to NVC.
Do you guys know more about this NVC? Can we call them? How long does it usually take for NVC to respond back to USCIS? I think my case is stuck till they receive the labor certificate from NVC.

Looks like your I-140 was filed with a copy of the LC that was substituted for you. You mentioned that they sent in a request to NVC to get the original LC. That means that the original LC applicant had his/her I-140 filed with CP option and on approval, the file went to NVC and might have gone to the Consulate of the original applicant's home country. The LC will be sittting in that file at that Consulate. Now it is the task of NVC (National Visa Center) to get the LC from the consulate and then provide it to USCIS for processing in your case. All I-140s applied with CP (Consular Processing) option will be sent to NVC after the 140 is approved so that they can they send it to the consulate for scheduling the CP interview.

Today my wife called the emergency no regarding her case status.That officer who answered her was very polite and he told that her name check done on Jan 2005(She got the LUD on Jan 2005) .Everything is ok,now it is with officer for final decision.May be they r waiting for my case approval.But she asked about mine.He asked the receipt no.That time she didnt note down my number.Again she called the emergency no for my case status.Some lady picks up and she was rude it seems.She told dont call this no.It is for emergency purpose.she told that case is pending with name check.She doesnt know how long it will take to clear!!!

It makes sense for her application to wait for yours to be approved because you're the primary applicant. However, I don't understand why the name check is holding up I-140. I've seen a lot of cases with an approved I-140, but with a 485 being held up waiting for name check to clear. Very inconsistent and rather frustrating.

For Fingerprinting on 485, you can see on the status when the notice went out to you and again when the fingerprints came back, in which case it will say the following in the online status:
"..the results of your fingerprint review for your I485 Application to Register Permanent Residence or to Adjust Status were received, and processing has resumed on your case. We will mail you a notice if further action is needed, or when a decision is made."
From your comments, I presume there is neither a message when they start name check nor when they have completed name check?
Only a LUD change or not even that?
