Labor Processing Times in California Due to 245i Part6

SESA is working on RIR SEP 17 2001

SESA is working on RIR SEP 17 2001. MY PD is 09/17/2001, but mu case is not picked up yet. MY case No is 138xxx not 135xxx

help to open branch office in DE

Hi All,
My employer is based in CA,They applied for my GC from CA
PD OCT 22nd 2001,RIR , EB3.

CA sesa is now processing around Sep 20th 2001 My guess is
that sesa will take one more month then DOL will take around
6 to 7 months.

What If my company opens a branch office in Delaware or Harrisburg
where the sesa is current and DOl will take around 4 to 6 weeks.
doing this Labor will approve in 2 to three months of time!!!!

Please put some light on it that how one can open a branch office
and apply for labor from new branch using RIR??

1. What are neccessary steps one should take to open a branch office?
2. How big the company should be -- if new compnay opening in DE or else where sesa is current?
3, Is it worth taking a chance.
4. ast but not least,
My employer can file for me from new branch office also keeping the one filed from
CA.i.e the same employer can file from two different branch offices located in different states??
 
Hello ansarianas,

Couple of things,
-Where is your primary place of work.
-Remember the labor has to be filed from the location where you work.
-If you are a Consultant then it is obvious that you will work where the client site is. Then the labor has to be filed from the location where the company HQ is located.

Other things you might want to consider.
Yes the Labor is Fast in DE, but then look at the 140 and the 485 times.
CA INS is currently processing April 140's compared to VT which is much behind. Then there is the 485, agreed that now you can file these 2 concurrently.
So look at the over all time and not just the Labor.
I mean it is only 7 - 8 months more for you, You have waited so long, But after that the 140 is only 3-4 months and if you do CP vs AOS, then your 485 will be ready with the 140.
 
Status Update

Hi Guys,

Just checking -

Are there any updates from people with denied LCs (LCs that went back to normal processing - non-RIR - queue)?

My lawyers say that we should be recving some response from DOL about my case (which was sent to normal queue - see earlier posts) by 20th Aug. We dont have any other option other than waiting - and may evaluate if anything else can be done before refiling an RIR if the DOL response is -ve.

Appreciate your updates.

I received a call from my attorney that DOL called her today and said that mine was approved and the file was misplaced and thats why they send and RFE. Moving to I-140/485 folks..

You wudnt want to hear my long pain story..Anyway here it goes..
My P.D was Ma 11, 2001. SESA misplaced my case in N-RIR. so, had to call them and let them place it in RIR. Wasted 15 days of processing time but got it moved to DOL.
DOL R.D is 26th nov, 2001.
Received a letter from DOL for RFE on 24th June 2002.
We responded to RFE on 30th July 2002 for which the R.D is August 1, 2002. I was just checking the AVM for my case status on 30th July, and the AVM was saying that mine was certified and the status was updated on July 18th. I took this to my Attorneys attention. She said that it was strange and asked me to wait for a few days until we get some paper work from DOL. I keep bugging her for 2 weeks(Most critical days) and finally I got a mail from my Attorney on 15th August.
Here is the exert from her mail in her own workings...

Your case is getting curiouser and curiouser.

I finally received a phone call from DOL just now and apparently your case has been certified BUT it was misfiled -- I did not argue with her.

She said she was going to send me the approval in the mail. Let's see what we get.

In the meantime, please fax me your most recent I-94 card so I can start working on your I-140/I-485.

How come the SF-DOL stucks again!

It seems that it takes SF-DOL for 1 years to process RIR case, is that horrible? Any predication on the speed?

DOL status (Dec case)

Hi All,

My labor was received by DOL on Dec 26, 2001. Till July when i used to call AVM, i used to get the message,
" Case No xxxx received on Dec 26 with a DOT code of xxx has been received. This status was updated on Dec 26, 2001"

On July 30, it changed to
" Case No xxxx received on Dec 26 with a DOT code of xxx. This status was updated on July 30, 2002".

They only removed the last "has been received" and no more update regarding what is the current status ? Its been 17 days since then.

Would somebody know what it means ?

Hi Labor_gc,
Sometimes, AVM truncates the messages. Sometimes it used to truncate the whole case details of mine where I used to call after a while. Looks like they took some action on ur file. Try it a couple of times.

Its been about 20 days and i have tried almost everyday a few times but i have always got the same message with updated on July 30 but doesnot say what action has been taken. Don't know if it is truncated or something else is wrong.

Anyway, guess i can just wait.
 
Hi,

I was just wondering if the fax back system works in DOL. I called the AVM and the status of my case received by DOL on Dec 26 has been updated on July 30, 2002 but the actual status is not updated. I thought it could be a problem with AVM and so decided to use the fax info option but its been a day and i have not received any fax.

Does the fax back option work ?
