Still waiting after PD due

Hi, All

My PD is Aug 21, 2001 but still have not heared from SESA.
Is anyone in the same boat?

Also, when I call SESA myself they say that they are not
authorized to give me the status on the case. Has anyone
succeded on geting the info from SESA?

anybody get approved after amendment?

I need to amend my wage. But my lawyer decided to debutt with SESA since the wage is too high for EB2 RIR software position. Does any body has the similiar experience and successed? My PD is Aug 23, 2001.
 
Wage for RIR EB2 Software Engineer, applications

The wage for level 2 is 46/hr. level 1 is much lower about 25/hr. I guess if you use master's degree they will put you into level 2.

It looks weird. When we call with details and its for us they give us the status particularly when it is due. You can check with your attorney.

Pm2002 and Nkelkar.

We can dcutt with SESA and they accept certain times if its with certain percentage. (as told by attorney)

Pal8, thnx for the answer. While my PD was in the future they would always answer me as the only answer was "your PD is Y and we are now processing X".
Now then my PD is in the past they refuse to give any answer on my current case status. They only agree to talk to an attorney so my big project now is to persuade the attorney to call them. Attorney operates with some stale data and still believes that my PD is in the future :(
 
On the wage thing is there a + & -.
Example. For software engineer using Masters Degree = 46/hr.

Is there a plus and a minus range??
What if you are over the published rate??
What if you are under the published rate?

Hi khelkar,
In my previous post, I mentioned this. Published Salary is only a base. If its more than that then there is no problem. If its less then it should not be less than certain percentage. You can convince certain times the DOL Officers on this issue but it need to be with solid Market data backup.

Let's see

It took them 1 week to process 2 days worth of RIR and about 6 weeks to process 1 day worth of non-RIR.

Back in March/April they were hiding behind "training new employees". These new employees should be experts by now. Can we try and find out when their going to pull their hands of their a$$es and get some job done ?

INS Authorizes Concurrent Filing of I-140 and I-485 Applications



July 30, 2002 - INS has published a long-awaited Interim Regulation that authorizes the concurrent filing of I-140 immigrant visa petitions and I-485 applications for adjustment of status. This regulation eliminates the need for employment-based immigrants to wait for the approval of the I-140 prior to being able to file their adjustment of status (I-485) application. Now, as long as an immigrant visa number is available for the particular employment-based category, the I-140 and I-485 can be filed together with INS along with applications for Employment Authorization Documents (EAD) and Advance Parole travel authorization (AP). This pertains to spouses and children of employment-based applicants as well.

If an I-140 is pending adjudication at INS, and a visa number is available, the applicant and the spouse and children can file an I-485 based on the already filed I-140.

This regulation provides for the ability to concurrently file I-140s and I-485s for applicants in the EB1, EB2 and EB3 categories. The effective date of this regulation is July 31, 2002.

I got RFE on Jube 24th 2002..
We gave ads for 2 weeks and my attorney just fedexed the reply yesterday...
When I checked the AVM today with my case #, it is saying that my case was Certified on July 18th 2002..My attorney didnt receive anything abt this...Confused..What now?????

congrats on your case getting certified.. can you share your RFE details in DOL tracking message board.

unfortunately, 2 of the board members in the DOL tracking message board got there RFE's rejected.. may be your experience can help future "remanded to employer" cases.
 
Sure..

But, That is from the AVM. We just send the responses yesterday. I dont know how they certified it even without receiving the response from me. I am waiting on the letter from them. I will share the details once I get the letter. I am still as confused as all are and keeping my fingers crossed...:rolleyes:
