Labor Processing Times in California Due to 245(i) Part 5

SESA to DOL transfer question

All,

My attorney sent my LC appliaction on 06/06/2001. The PD is around 18th June. Since SESA is doing cases with PD 06/21, my application status could be one of the following -

1. Its processed, approved and transferred to DOL. In this case, question is how long EDD takes to send an approval notice to lawyer. I asked my attorney yesterday and they have not heard anything from SESA. Any idea?

2. Its processed with some objection. Again, in this case, how long does EDD take to send an inquiry to lawyer. Comments?

3. It has yet to be proccessed. In this case, I have to wait?

Hi asic chip, my PD was 6/15 and I\'m still waiting to hear of an xfer.. so I guess it takes some time.

received the "Transmittal Notice" for PD July 18th...

I received mail from the lawyer saying that she received "Transmittal Notice" on Jan 30 from EDD saying that my labor cert has been forwarded to the DOL.

My labor was sent to SESA on June 12th. I received PD as July 18.

I think your priority date should be 18th June..since you send application on june 12th..If it is july18 then it\'s really bizzare..

Strange \'Labor\' situation - Any ideas?

I am about 5 months into my labor cert process (RIR)in california. The division I work for in the company is likely to be bought out by another company and that company is very keen on taking me as their employee - my position, compensation, title, location and everything else will pretty much remain the same. I only have about 1.5 yrs left on my H1B and this other company is very sensitive to my green card needs. They think that my current labor process should continue without any problems. I am concerned that if I join the other company, I may have to start over.

Any thoughts? Will it make any difference if my current employer agrees to keep the process going?

It\'s not a \'strange\' situation. It has happened with lot of people and I think there should be no problem with your immigration process however you will need to refile some documents with SESA/DOL. Check with your lawyer he should be able to help you.

No Title

As \'EvilMind\' suggests, this is a fairly typical situation. The new company typically assumes the new employee with \'interest\' (I think that is the legalese they use) which basically means your GC can continue with the new employer with the same old PD. The new company has to file some papers to the effect that all the docs filed by the previous company still holds true in the changed scenario. Hope that helps.
 
Big Question

Hi Guys,

I have been following this board since a long time and find good info. I have following problem, if you can help me then I will really appreciate it:
I was working in Bay area and my Labour was filed with SESA on 28th June and my PD is 2nd July. Then in December my company offered me a transfer to Texas. And as that was the only option, I moved to Texas in January. My question is, is it okay / legal to continue my GC from California ? Also, as my work place has changed for more than 50 miles, I will have to file H1-B Amendment with INS for work place in Texas. Will this affect my GC if I continue it from California ? To start the whole process again in Texas is going to be a pain as it is very slow and of course I will lose this 7 months. Currently they are processing Labour of March 2001 for RIR and January 2000 for Non-RIR ! Please give your suggestions.

Most of the 245i cases are must be in non RIR?? How does it effect RIR processing. Is it due to the resources limitation or what??
 
Unfortunately Yes

It seems you really have a big problem. Yes you will have to file for new Labor Certificate from Texas and secondly you will have to file H1-B Amendment with INS for work place in Texas. The only way out I can think in your case is if your transfer is of "temporary" nature otherwise good luck. However I will strongly encourage you to talk to your lawyer as he/she is the most authorative person to talk on this issue.
