I Concurrently applied I140, EAD, AP & I485 for myself and EAD, AP & I485 for my wife togeather and all our ND's are 9/5/03.
While checking the status I found on my I485; it says there was insufficient fee; I spoke with my lawyer and he told it was a mistake on BCIS sometimes the consultats in BCIS who are hired make mistakes like this by putting RFE without any problem although the payment was correct. My lawyer had to issue a new check again after cancelling the older one.

Following are my questions for experts and if someone has gone through the same scenario.
1. Does BCIS Update the status with the same EAC# if there is any RFE or do they issue another new EAC#.
2. Having RFE on my I485; will it delay my I140, EAD processing until the RFE response is received and process.
3. Normally how many days does BCIS take to process the case after reply is received for a RFE.

My 7th yr H1 extension came two months back. I havnt yet sent my passport for stamping.
My 140/485/765 was mailed last month on and the receipt date is aug 25.

My question is ...
My client wants me to travel to Australia on a bussiness trip next month.
So can I travel to Australia , if I get my 765 approved and get an EAD
and AP ? remember I dont have a h1 stamp on my passport.

If you have a approved AP, you can enter into US. You dont need a valid H-1 visa stamp.

RFE for tax return

I had concurrent filing for I140 and I485 in July. Just got a RFE today requiring the tax return copy. I lost my year 2001 tax return copy so I requested computer generated tax return information from IRS and mailed it with all applications in July. My lawyer said it might be put with I485 so they are requesting for I140. Does anyone know if the tax return from IRS is acceptable?

Thank you for the reply. I forgot mention this...
There are two types of copy you can get from IRS. One is the computer generated list that has less inforamtion than the one we submitted to IRS. The other is the photo copy of the one that we normally sumitted to IRS. I had the former one. Is that ok?

What is going on with cases with a ND of 8/21? Cases with later EAC #s have been approved much earlier?
