Interview Recording

Folks,

I was wondering if USCIS records our interviews? Either on tape etc? Does anyone know if this is true?

Thx.

I have seen in movies that they record the interview. Not sure how it is in real life.

I guess so.... without this, USCIS could face lawsuits.... without consent, i guess such tapes won't be admissible in court.
You're consenting to it the moment you raise your right hand and swear to tell the truth..in other words you're under oath.

That consent is to tell the truth, not to record the interview I think. What I was trying to say is about the recording only.

There is no question of whether to tell truth or not. As we are under oath, we should tell nothing but truth.

When you are under oath, there is no consent needed to record your statement. For example, court proceeding are routinely taped or steno graphed yet the defendants are not required to first consent to being recorded.

Oh I see... Now I got your point. Thanks.

Thanks folks. The reason why I am asking this is because picture this - what if you go to the interview and you answered it in a particular way and later if for some reason the IO gets back saying that you lied etc, so at least fall back on the recoding or transcript and prove yourself.

I know it sounds hypothetical totally but I hope you guys understand what I am trying to get to.

So you're basically asking what protection an applicant has from a lying IO? Seem like a far fetched scenario that you shouldn't worry yourself about.

Yes Bobsymth...I am just trying to see if there is something we can fall back in case of such a scenario.

I know i may be thinking way too much...but for whatever it is worth..just wanted to ask the forum and get the feedback.

Thanks again...

Your interview will most likely not be recorded. But for what I have read in the months I spent researching the N400 process is that Stokes interviews are recorded. These are the interviews that are performed for some marriage based N400 cases where the husband and wife are interviewed separately about very specific details regarding their relationship and life together. The same questions are asked to each partner, and then the IO can review the tapes to make sure that the answers match.

If an IO knew the interview was being recorded, they wouldn't risk lying during interview since it can be reviewed later by applicant via FOIA request.
