India DUI - OCI/Tourist Visa

Hi All,

I have a DUI from 1.5 years ago and was wondering if getting an OCI will be an issue. If I am rejected on the OCI for my record, can i still get a Tourist Visa? And has anyone successfully gotten an OCI/Tourist Visa by disclosing the criminal record.

There is no definitive answer to this question since it depends on the specific situation. Generally speaking, if a person has been convicted of a DUI or any other criminal offense, they will likely be ineligible for an OCI/Tourist Visa. However, it is always possible to seek help from a immigration lawyer in order to discuss this further.

In a same boat ? Did you got the OCI?
 
There has been few queries about filling part B for OCI application when one has DUI conviction. It’s mainly about the question -
Have you ever been convicted by Court of Law of any country?
My advice is be Truthful.. it’s better be DUI misdemeanor and not. Felony. For this questions answer, Mention the date of incident and court orders (fine, probation, community service etc.) all of those should be Done.. and case should be CLOSED.
Get a certified copy of case records from the court. And upload as proof with OCI application and send a copy with physical copies.
DUI misdemeanor is not treated as Red flag as long as it’s not Felony and/or aggravated incident.
You should be good to get approval.
I had DUI from 2018, In July 2024 applied for OCI following above steps.. OCI was approved within normal approval time (4-5 weeks)
Don’t worry much.. simple logic Be truthful.. case should be officially Closed.. attach certified copy of court order !!! You will be fine !!
