I am reposting this message I have posted in reply to other messages ...
I was told by IGate that I had received the notice for the amended I140. IGAte\'s LD also has advised me to contact the VSC directly to tell the new number and request to unfreeze my application (since I485 is no LONGER an employers application but our responsibility). ......those in AmendedI140 list ...when U get the notices do it so immediately as I saw a posting today where his lawyer phoned and updated. He got the GC approval.

I will update with details once I receive my notice in my mail ......

Mine is Proactive I140 - Apr 13 - Approved Apr 25 - I got the notice from the IGate LD also. Trying to get in touch with VSC to update as advised by the LD.

My I-140 was submitted on Apr 20... Mine is not yet approved and I did not get a notice from IGATE LD asking me to unfreeze my application.

What is the process for doing this? What do I tell the IIO when I call them up?

Would appreciate a detailed feedback

I contacted some idiot (IIO) in VSC and she said my case along with all the other IGATE employees is on hold. She went on to say that all the cases of name change are on hold and filing an I-140 amendment will not help at all. I contacted yesterday morning and here are my details.

As per what Krishna Venkatrama tells us, we need to contact VSC and ask them to \'Unfreeze\' our 485!! Is that possible? Can we tell IIOs what to do and would they oblige???????

gcnohope your name is already on the list and the proact I140 is listed as filed on 04/13/01 as requested by you in your previous mail.
I am not maintaining any PD or NDs because when we started this list we were interested only in the company name change issues such as related RFE dates, RFE approval dates ( redo I140 approval date, not receipt date ) and finally the I485 approval date.

As per law you are allowed to substitute one I-140 with another on a pending 485 application. This is what we should request them to do. To susbstite IGate I-140 instead of Mastech I-140 on your 485 application. Once that is done you are no longer a company name change case because your I-140 has the correct company name. Then we can request VSC to move I-485 out of hold because there is no company name change. IIOs are a confused lot. So unless you explain clearly what you are asking they will in turn confuse you and refuse to do what you want.

Guys, I dont know how to get proper authentic and reliable info. regarding when the holds will be released and who to trust. Do you guys have any plan to atleast get INS HQ and VSC to commit to some final dates for this issue. How about query to Kevin Rooney and / or some Policy head at HQ and cc: the same director of VSC. This query should be sent by a well known immigration lawyer on behalf of all us. We can all pay for it. We should try to get a firm commitment as to when the holds will be released, and by when these I485s will be approved. We cannot keep waiting forever, hoping that in a couple of weeks the regs. will be out.
Every couple of weeks someone on this message board, gets info. from some \'source\' ( upto now all sources have turned out to be unreliable ) that the regs. will be out in 2-3 weeks. When I talked with some person in Apr, I was told that these are due out in mid-May. Now some other person at HQ tells Shailesh Gala ( of ISN.org ) that it will be another 2-3 weeks before a memo will go out to all the district offices. But the regs. wont be finalised until \'the whole world\' approves them.
- I am wondering what is the reliability that a memo will go out in 2-3 weeks to all district offices.
- Does it mean also Service centers including VSC ?
- Will it clearly specify that these should be released from hold and processed as per the provisions in the memo until the final regs. are out ?
- In what respects and in what form will the HQ enforce the memo such that VSC cannot make exceptions ?

Why doesn\'t IGATE\'s LD ask the lawyer\'s office to \'UNFREEZE\' the cases on hold. It is not a good idea for us to call the VSC and then tell the IIO what to do. Let Lawyer talk to some officer at the VSC and explain the case details.

What do you guys think.

May be one of you who have received the I140 receipt should suggest that to LD.

I called VSC 5 times for last 3 weeks, talked with different people each time, asked them _directly_ whether my case is on hold or not for any reason and I was always getting the same answer - no, your case is NOT on hold...

call them again, they might tell you the bad news. I called them 5 times too and 5th time they told me that my case is on hold. Till then they cheated me saying that it is under review and I should be hearing soon, blah blah.

I agree with both vsc_on_hold and intrepid.We cannot rely on VSC lifting the hold any time soon. Every week there is a posting that regs will come out after couple of weeks. How many of such couple of weeks passed already? where is the result? WE all seem to be living in a fools paradise.

The best person to call VSC on lifting the hold is lawyers office. They are representing us on I-485 and it is their duty to do that. But they are hiding behind LDs skirts and LD wont ask them to make the call. We should try to make LD ask lawyers to make the call.

But if that does not happen what is the strategy? My interest has now become more on regulations because of change of employers
