I130 through my husband

My husband filled an I130 in november 2008 while being in the states,( i m british) and we ve received early december the receipt notice. how long should we wait to get a response?

he is a US citizen from birth, no he only sent the I130

Send the rest too!! You'll get EAD so you can work anywhere and AP to travel Plus it'll be faster to get GC, because I-130 and I-485 are done in same time. Now you separate them out and it'll take twice more time.

before advising to file I-485, you should ask if the original poster is in the US. Because if she isn't, she can't file I-485.

Oh, I assumed so (she said "while being in US"). But you are right, consular processing is different.

will there be any problem with if the petitionner doesn t work anymore but supported by his parents.
 
You can use co-sponsor (first), and assets (second). If by the time of interview you'll have a good job you can serve as self-sponsor.
 
since you are in the States (legally, I presume?), you should file I-485 with applications for EAD, with a copy of your notice of receipt for I-130 attached.
That's unless you are planning to do consular processing.

I came with my british passeport(visa waiver 90 days) , my status is still pending

what do u mean by consular processing??
 
that's exactly what it means - consular processing - getting an immigrant visa at a consulate abroad instead of adjusting status in the US.
 
Double check if visa waiver country's citizens are eligible to file I-485

1) Citizens of Visa Waiver countries are allowed to file I-485s.
2) People who enter via the Visa Waiver are eligible to file an I-485, only if they are adjusting on the basis of marriage to a US citizen.
