I-140 RFE Cases in TSC

   Thanks! I hope that U hear the good news soon as well. Atleast we know that TSC is doing something about RFE cases.
   I had opted for CP, but I am debating it now. If I go with I-485, it will be in Nebraska.

  I am still debating it.. I may still go for CP. THE AVM IS UPDATED. They dont have the receipt notice yet.
  Do U know how long it takes for the receipt notice?

Your Approval is like a ray of light in this Dark RFE world. I Know God is testing all of us suffering in TSC and We RFE guys are singled out form more harsh test, But any way we will have our day.

  Thanks for the update. Here is my analysis. It may be flawed.

PKalai - 1st RFE on Jan 17th . Second RFE Mid March.
Myself - 1st RFE on Jan 23rd ?? (It arrived in lawyers office on jan 28th morning).
Yourself - Second RFE on Jan 27th. So I am think U will get your approval next week (latest). Pls check AVM this weekend.. U may hear the sweet news.

RD JUNE 2001 ND JULY 2001 RFE RECVD DATE JAN 25TH 2002
APPROVAL DATE ???? (still waiting)

I got labour cleared in Atlanta and applied 140 in TSC.
As you know well that TSC is taking two or three years to approve 485,Is is okay to try other Service centers like VSC Or other.

My employer is located at Atlanta,Georgia and I work at Virginia.
Based on my working area, i would need to apply at VSC.
KIndly reply?

Hi Bhaskar,

My case is similar to your LC from Georgia and 140 from TSc and I live in NJ.I asked my lawyer and he said that I can file my 485 from VSC as it the place where you stay matters.

I-485 is based on your address of residence. If it in VSC it is good that you can scape TSC which is extremely slow.

They wanted more financial information of my company even though we had submitted those details.

INS want the proof for company name change as well why we have not notified DOL since name change happend in between labor.

Sorry to hear trouble you are in.

I guess you used new name of the company while filing I-140 petition.
I think you must reply this very carefully as INS is questioning the very nature of affairs your company handle. Name change is a big thing but your company failed to notify DOL. I will suggest take advice from a good lawyer besides the lawyer who is working on your case.

When I submitted it the first time Lawyer had attached company\'s 2000 tax returns, 2000 profit & loss statement. But they came back asking to give current financial details of the company stating whether they are in profits or losses. Actually they were in profits and that was reflected in 2000 P&L statement.
So again we submitted 2001 P&L statement & all the quarter federal filings of the company, Bank Statements and that was sufficent for them.

I have a question regarding the H1 Extension. My current H1B expires on April 14th 2002. My company has applied for a extension and I received a receipt notice on February 7th. However the Receipt notice says in the case type column

Case type : I129 Petition for a NON IMMIGRANT WORKER
Amount received $1110.00

Nowhere in the receipt it is mentioned as a Extension for H1B1 .

My question is
1. Is it normal in the petition to say Petition for a non-immigrant worker even though it is an extension.
2. Why is it not mentioned as Extension.
3. Should I be concerned about it or just wait for the approval.

Your help is greatly appreciated.
