Hi dear friends,
my I-140 has been approved from NSC. I would like to share my case details and wish everybody good luck. and I would also like to thank you all for the support and company you have provided to me through the forum. and special thanks to Shivany and NYC2001 for sharing your experience with me.

LC Category (EB1/EB2/EB3): EB2
LC PD: Jan 2003
LC AD: June 18, 2006
I-140 Receipt Date (RD): 07/19/06 regular processing
I-140 Notice Date (ND): 07/19/06
I-140 Last Update Date (LUD): 08/11/06(don't know the reason)
Email about RFE mailed out on 01/31/07
Email about Receiving RFE response on 3/5/07
I-140 approval email sent on: 03/11/07(yes, sunday morning)
I-140 Approval Date (AD) stated in the approval email: 03/7/07
Concurrent filing (Yes/No): Yes
 
I-140 Approved

I just received an email notification that my I-140 got approved.
Now my wait continues for my priority date to become current.

HI NYC2001 my fellow LC/140 sufferer,
congratulations!
i am sure you already know but i just thought i'd point out to you that you might want to consider filing another LC and 140 in EB2 category and transfer your EB3 PD to file your 485 when the second 140 is approved. it is doable and it only requires the support from your company and costs some $$.

CONCURRENT FILING DATE IS OCTOBER 06 EB2 WORL

is there n e benefit on switching to I-140 PP now, since even if it gets approved in a week or so, the 485 arpproval won't come n e quicker......

a lil confused and not sure if there is n e benefit at this time to shell out the extra thousand plus attorney fee for switchign to pp

would appreciate n e suggestions from the experts

I was wondering the same. From looking at the trackitt tracker, it looks like it takes about 8 months to get I-485 approval (concurent filing) but it seems like it takes only 5 months after approval of I-140 to get it ... I am still looking at the trend to see if I should put out the $$ for premium processing. Any one has any thoughts regarding this ?

Seems like we received the notification the same time.

Thank you for your suggestion, but I will be travelling for a while and will decide when I return in May as to how I should proceed. I am just glad that the first few hiccups are over.

MDWatch:

Spending money on premium processing on I-140 for concurrent filers is worth only when they want to use AC-21 portability.
 
AC21 allows a H-1B beneficiary to change employers after I-485 is pending for more than 6 months and I-140 is approved.

From the rule I thought that I could also be self employed or be employed by my wife if she starts a business...

Are there any statistics for the number of denials after one gets RFE. I got an RFE for W2 and company aquisition agreement. If everything is normal (and legal) , should it be straight forward. ?

What are they looking for when they give an RFE asking you for W-2. Is it to check if you are employed with the same company during those years or is it to check your wage at that time ?

Maybe, the experts can chime in on this one.

My take on the W-2 issue is to check the company's ability to pay you as a future employee.
