my wife's H1 is going to expire soon

My wife applied I 140 on May 3rd and her H1 is going to expire on Aug 2nd. In order to extend her H1 her I 140 should be approved before Aug 2nd. My question is......is there any way that she can extend my H1 with out the I 140 get approved.

I am in the same situation, in fact, my H1 expires on Aug 2nd too. My PERM was filed on 11/15/2005. My I-140 is pending and the details are in my signature.

If my I-140 does not get approved before Aug 2nd to enable a 3yr extension, the only option for 7th year H1 extension is recapturing days which I stayed outside US to show that the PERM was filed before 1yr. I had about 60 days that can be recaptured. As Aug-2nd is nearing and with I-140 approval probability not so promising, my lawyer advised me to stay outside US the remaining required 45 days, before Aug 2nd to enable the 7th H1 extension based on recapturing of days spent outside US.

It is just introduced, so in the coming weeks, we should start sending emails in support of the bill. Believe me, it works, the Congressman and the Senator from my region, both replied to all the support emails that I write.

AILA, usually has a pre formatted email, where you click and it sends a fax.
You might also want to change the matter to suit your likes.
 
How long NSC take to approve EB2 140?

Guys,
I know its very tough to predict the time to approve 140 at NSC but what is your take? Will it be approved in 3-4 months. I heard now adays its taking less than 2 months? My employer says they are approving it in 3-4 weeks in EB2 category. Did any of you get approval in such a short period?

At 140 stage can I claim my old PD (1st GC 140 was approved). Did any of you got it?

Finally got the case number from USCIS

My company filed I-140 application based on a pre-approved labor. We have the UPS tracking number shows the application was delivered on May 23, 2006. However I did not receive the receipt yet. So finally I called USCIS National service center and got the info that receipt was generated on 6/29/2006. The representative also provided my case number.

Also I got following concern from my attorney
On the pre-approved labor the requirement is Bachelor of Science and then Major field of study says: Engineering, Computer Science or related field.
I have Engineering degree (4 years) from India and then Masters in Computer Science from US.
Our company's attorney says, we filed the application but since it does not say Foreign degree will be accepted or Masters degree will be accepted in lieu of Bachelors on the pre-approved labor, chances are very high that the outcome of this application will not be successfull.

After reading some of the threads, I think my company's attorner is thinking very conservative, I wanted to get opinions from you all gurus.
Is there anybidy else is in this situation or recently approved in this situation.

The same time Labor Application does not say "US degree only"

What your lawyer said is pointless from my point of view

Just got my 140 yesterday ... excited ! Does anyone know if there is something I can do asap so I don't have any delay in filing for 485 now. (doc visit, etc)

can get ur medical done, chk ur local assigned doctors for immigration purpose, they have all the forms, but make sure he is the assigned doctors to do the immigration medical works, often it take 3-6 days. and also keep on collecting all the papers u might need which u can get from your attorney. wish u all the luck.
 
I am curious, how can you file your 485 when your labour PD is 31-JAN-2006?

maybe i am wrong, let me know what i am missing here

I checked the status online. it's approved.
i am yet to get the notice from the lawyer.

I got the notice from the lawyer that I140 approved.

I am in the same boat. My H1 6 years end on Sept11, 2006. I need to get some decisipnon on my pending 140 by end Aug. I was going through the USCIS site : http://www.uscis.gov/graphics/fieldoffices/nebraska/aboutus.htm
It seems that we can write to customer feedback , the only thing is we have to rely on snail mail since there is no email id to send the letter to. There is also a mention of 'Requesting Expedited Handling', but our cases may/may not fit the criterion, so not an option.
But we can definitely write to them about unfair treatment (I mean timeline wise) for the applications processed at NSC, explain the situation like some cases filed in June got the decision at TSC. Many people who applied after me got their approvals. We are patiently waiting and do not see any movement at NSC.

At the least if we know when the premium process starts we may get some relief.

Somebody coming forward to draft a letter on similar lines? I am not very good at it.

Folks,

I am new to this forum, so apologize if my question sounds stupid.
I would like to know how the decision is made where to file I-140 - does the center get assigned by USCIS or can you choose where to file?
