Hello All,

Would greatly appreciate your help on the following questions:

1) My I-140 case was recvd by VSC on Jan 24'06. It was transferred to NSC on May 17, and received by NSC on May 24, 06.

However, my case # is still showing up as EAC-XXXX-XXXXX. Since I have read that the case #s for NSC begin with LIN-XXXX-XXXXX. Will my case # change or remain the same?

Receipt # won't change even case transfers.

2) I spoke to the legal firm and they have still not received a case transfer notice (been more than 6 weeks since I recvd the email from USCIS). I'd heard that sometimes in such cases, having the attorney initiate an inquiry helps. Is that true and what should I tell my lawyer regarding this.

3) I received Receipt notifications (RD 7/3/06) from NSC (all LIN #s) for 485, 131 (AP) and 765 (EAD). I also received the FP Letter for appointment on 7/17.
a) Will this now be considered a concurrent filing, since now am awaiting approvals for 485 & 140?

Yap

b) Will there be any problems linking these cases together for NSC, due to the EAC # for 140 & LIN # for 485 and rest?

No issue...based on I140 Service center accepted I485. There is no question on linking..
Also, please advise if there are other issues that may arise that I may not be aware of. The legal firm that my employer uses is not very helpful and so, I would like to go to them with my requests once, rather than again and again.

Thank you all!

I agree that organization like AILA have a better leverage with NSC but it wont hurt to use dual track approach. Let us contact AILA representatives through prominent and big lawyers like Rajiv, Mathew OH and others...Also let us our senators and congressmen know that while TEXAS is processing June dates, NSC is still stuck with Feb cases. The whole purpose of sister centers does not seem to be working. Simultaneously we can also contact NSC through snail mail or other ways and ask them about the processing procedures.

I had been stuck in PBEC and I know until and unless you make yourself heard no one wants to listen to you.

Of course AILA has better leverage with NSC and we should try that option, but at the same time there is no harm in writing even snail mail to NSC. Lot of mails will make some difference.
If we know fax number it would be better.

One good thing is eFlame has RD in March end and NSC has touched his case recently. So there is some movement, a +ve sign.

NSC in high gear

I140 for EB3 have jumped to 3/17/2006 as per AILA's NSC Processing Time Reports

Sounds good. But USCIS site which is updated on July 11th, does not show any movement?

Also, I-485 seems to move as well. AILA get reports directly from the Service Centers and on different dates, so we should see these numbers in the next official NSC report.

Yes, it definitely looks like there is some action coming out from NSC now. For some reason they stopped processing cases since may but they have resumed processing from around this timeframe, end of March beginning of April. Will they pick up speed? Will they stall again? Stay tuned, the drama continues...
