Approval letter question

My I-140 was approved on 05/22. My employer got the original approval notice on the 25th May. I havent received anything directly from USCIS. Am I supposed to get an original approval notice from USCIS?

Hi scatcat

Your application is being processed by Texas Center. Nebraska center makes decision on individual basis to process it in Texas OR in Nebraska. Yours went to Texas. Texas is better then Nebaska.

Good luck.

Hello ww-gc
How were you able to file concurrent filing since you are EB3 filer with LC PD 10/2/2001? the current visa dates in EB3 are not in that range as yet.

Haven't got receipt notice yet. :(

Your experience letters are good. If you have 4 Yrs Bachelors degree and 5 years "progressive experience" and can prove it you may still qualify for EB2. Ask your attorney for a fax of RFE and you will know where you stand

i have 5 years education, & 5 years experience(but i had 3-4 months break in one of the job). Does it come under Eb2? Whats "progressive experience" means? will that affect in my case...

pls clarify....

Hi, ropa,

Good question.

There is a new update from Nebraska Service Center allowed to do so.
http://www.immigration.com/newsletter1/nsc10april06.html

But, I don't know how they will process my case.

They wanted to say that they are processing cases which already had been filed when retrogressin did not exist, and they will not approve retrogressed cases, just do some paperwork (Officers may be required to issue a request for evidence (RFE) for some cases) kind of preparation to be approved without delay when PD for them becomes current.

They did not say that they accept filed I-485 applications if your PD is not current. Your I-485 will be denied.

Receipt not yet received almost 3 weeks later

My I140/I485 was sent to NSC on 05/10/06 and delivered on 05/12/06, but now almost 3 weeks later, I still did not get the receipt. Anybody had similar experience?

Actually if you read other threads you realize that the one of the goal of retrogression is to eliminate backlogs in USCIS/DOL and there is no other basis for retrogression. (even for India and China)

They want to comply the requirements to process cases not more than for 6 months

Why would they want to make backlog bigger to accept retrogressed cases ?

Worrying.

I think you are right. so what i have to do right now.

The most important is that if you get EAD and AP baseds on filed I-485 (they issue them without looking at the case) do not use them. If you use EAD even for one day and later they deny I-485 and EAD with AP you become out of status right away, it is not possible to maintain H1 status after that.

Thank you.

sfmars,

But i'm on my 7 years h1 right now, and it will be expired on Nov. this year.
Do you think i need to extend my h1 right now? how long i could extend my h1? another 1 year or 3 years (somebody told me, i could extend another 3 years, i don't know if it's right).

Thank you very much.
