Sorry to hear that. If I understand it right, your pay at the time of filing 140 was less that the amount on your Labor Application. That is normally not good. What does your attorney have to say about it. I recomend you get a second opinion from another immigration lawyer and file the appeal.

I was told by myAttorney my I-140 receipt was received on Friday May 06th 2006.

LC ApprovalDate: Mar 30 2006
Received Date: April 24 2006
Notice Date: April 26 2006

According to May USCIS News letter for EB2 INDIA Cutoff Dates are Jan 03. For filing I-485 application is Labor Receipt Date Considered as Priority Date ?

Based on your lC priority date orlabor receipt date which is Jun 23 2002, you should be able to file 485.

I think in the nearest future it will take more than 6 months to get approval from NSC like it was one year ago.

The same time I see (from other threads) that VSC sends their all old cases starting from January to NSC.

Lucky people whose cases moved to TSC they get approvals less than in 3 weeks.

My 140 was approved May 6th.Now on the long road remaining for 485. Good luck to all that are waiting. My wait was (incl Labor) was long and tenuous.

Congrats

Could you confirm that your I-140 case was filed sometime around end of March and you got approval from NSC (your case starting with LIN). ?

A lot of people in EB3 category in the tracker who has RD around beginning of March and their cases are not approvals.
