H1 Extension Application

Hi,

I would like to know the information regarding h1 extension, i have been in USA since 2 1/2 years, i would like to extend my H1b, so for this how many months/days before do i need to apply ? Let me know asap,

Your employer has to apply for the extension, you can't. Just make sure they also apply for extension of status, not just the new extension, otherwise you have to leave the US and get a new stamp.

your employer has to apply for H1 extension. employer may be having lawyer he will apply. one can apply extension 6 months before I-94 expiry date.
If you have spouse or kids on H4 status then also file H4 extensions with your H1 Extension and inform lawyer you have family members on H4

Thanks for the quick reply.. What do you mean the status ? If my employer apply for my H1 extension, automatically i will get the status, i mean i am legal to work in USA. If i go outside of the USA, i have to get it stamped. If i am wrong please let me know.

if employer file H1 extension before I-94 expiry date then you are in status and with H1 approval notice you will get new extended I-94 attached and you can work in US. if you go out of US then you need to get Visa stamp to enter if visa stamp is expired.
