Green Card Lost in USCIS

Hi Everyone,

I received my Green Card in 2008.

There was a problem on my GC, issued date was wrong (2002 instead of 2008), So I send the I90 form once without GC and my application got rejected, then I send the I90 form along with my GC more than 1 month a go (July 30th). I have not yet received a receipt notice.

I called USCIS today again, I was not able to talk to an IO, a customer service rep told me to wait another 15 days, however she told me that as my file is not updated in their system I can not get an I551 stamp. Note that she did not ask my full name she only asked my A number.

The other issue is that I am changing my apartment by Aug15th and I don't know how to change my address in USCIS without having a receipt number. I have heard that AR-11 does not change the address on all individual cases.

I talked to my lawyer, she told me that there is a possibility that they do not send me another receipt at all and they may send my Green Card directly and I told her about change of address without receipt notice and she claims that as you have an A#, then sending an Ar-11 will be sufficient. Basically what my lawyers are saying is that forget the Receipt notice and wait for your GC and only change your address through AR-11.

This has become really tough as I have travel plan in September.

Thanks a lot for your help,

Troy

The process to get the replacement takes more than a year, do not expect less than that. Stamping, as I understand it, if there is a delay in issuing GC not for lost, replacement, renewal or fixing a problem in the card. Changing address is not a good action and make a lot of confusion to the USCIS whatever you do. In a good proportion of cases (personal experience) they send to the address in file and do not check address change.

I have not yet received a receipt notice.
----------------------------They will not send reciept notice. They send reciept notice only if you pay fees.

I called USCIS today again, I was not able to talk to an IO, a customer service rep told me to wait another 15 days, however she told me that as my file is not updated in their system I can not get an I551 stamp. Note that she did not ask my full name she only asked my A number.

------------------------ AR11 does not change the address on Pending petitions. you can write a letter to USCIS where you sent your I-90 and sent card and can update your new address. send the letter with certified return reciept and out side the envelope write big bold letters. Filed I-90, Please change the address and send Card to new address. write cover letter with your name, DOB, I-485 filing reciept, A# and explain that you filed form I-90 on date... and sent the Card with I-90 as your Card had incorrect info due to USCIS. write your new address . keep the copy of each document you send to USCIS.
I talked to my lawyer, she told me that there is a possibility that they do not send me another receipt at all and they may send my Green Card directly
--------------------that is correct and it may take 6 months for the Card.

and I told her about change of address without receipt notice and she claims that as you have an A#, then sending an Ar-11 will be sufficient.
---------------wrong. AR11 dont change the address on pending petitions but if you file AR11 online you get the option to change your address on pending petitions with USCIS. I dont have exp if they update the address online. do the both do online and also send letter.
Basically what my lawyers are saying is that forget the Receipt notice and wait for your GC and only change your address through AR-11.
--------------they are correct. nothing wrong in sending letter to USCIS for address change so that they send Card to new address.

This has become really tough as I have travel plan in September.
----------------you did a mistake you could have sent card after your trip.

Thanks a lot for your help,

Hi mmed,

My major problem now is I don't even have a receipt. and my I90 is not even in their file. Generally stamping work here, however the problem is as my I90 is not in their file I cannot even stamp the I90.

About change of address, I have no choice. and the fact that I do not even have a receipt number, make it more difficult to change of address.

Please help

Many thanks

Hi Ginnu,

Thanks a lot for the information,

Do you know why they can't even find my file in the system and what should I do about that? Some people suggest initiating my state senator or Repersentative, does that make any sense?

You have an statement that "USCIS will not send reciept notice. They send reciept notice only if you pay fees", if thats the case then how can I follow it up or do anything, specially as it is not even in their system

Any suggestion on getting a 551 Stamp

Many thanks

Troy

Make an Infopass appointment, take the I-485 approval notice and explain the situation and try to get your passport stamped. If they won't stamp it, contact the Ombudsman.

99.9% the person answering the phone do not know anything and usually gives confusing or wrong answer, do not rely that much on that. Due you track the mail to the USCIS, if delivered, then it is there and it is just matter of time.

Hi,

Thanks a lot for the help,

I called USCIS again, and theis time the CS was more helpful and she told me that a case without a check does not have a receipt. I discussed the change of address and then She transferred me to another CS or IO , the new person told me that she can see my file and it is pending I asked her the receipt number which she gave it to me however the USCIS web site does not recognize the new receipt number.

This is kinda wierd.

-----------------Dear, only USCIS knows.
Some people suggest initiating my state senator or Repersentative, does that make any sense?
------------------------you must do that.

---------------------------- they dont send reciept if you file I-90 without fee. You must contact Contact your congressman /senator local office and provide the full details.

Any suggestion on getting a 551 Stamp
------------------------------Take infopass and ask for the stamp in passport. FYI Local USCIS office may not stamp the passport they ask for I-90 filing reciept. If they refuse to stamp the passport then ask for Supervisor and inform that you filed I-90 and sent your Card as your GC had incorrect info due to USCIS mistake. Take the copy of I-90(that you sent) and Card or if any evidence like post office return receipt show them. Take your I-485 approval notice or any evidence of your green Card approval with your A#.Request them that you your employer want to see the Stamp in Passport or GC Or inform that you have to go out of US for few days. update us after your Visit to Local office.
Many thanks

Good Luck!!!

I have quick question regaridng AR11. I have a pending I485 since 2005 and last year I moved my home address. I filed AR11 on the website and receoved confirmation from USCIS in the post a few weeks later acknowledging the change in Address. Since then I have applied for AP & EAD and haev received those in the mail.
Do I still have to write to USCIS again notifying change in address on I485? I thought I had already done this when I filed AR11.

AR-11 has nothing to do with pending USCIS applications. However, if you did it online, you probably did both AR-11 and changed your address on the pending I-485. The online system guides you through both the AR-11 and, once completed, asks you if you want to change the address on any pending files.

Submitting AR-11 does not result in a confirmation letter. Submitting a change of address request for a pending USCIS application does result in such a letter. Since you received a letter, it must be in relation to your I-485. It should say so right on the letter - check it!

AR11 does not change the address on pending petitions. You can send certified return receipt letter to USCIS service center where I-485 is pending. Write request letter with your Name, DOB, A# and I-485 filing receipt. Top of letter write Request to change address on Pending I-485 in big letters. Then make a request to change your address on I-485, write your present address then also write that your previous address was.... attach the copy of I-485 filing reciept with request letter.
Sign the letter with date and your address. Send the letter and outside of letter write in big bold letters ATTN: Address change on Pending form I-485
** keep the copy of letter that you send to USCIS.

Do we really need to send a letter for change of address for pending 485? I moved to my new place last year and did AR11 online and as jk0274 said it guided me thru AR11 and Pending applications. I did change my address on my pending 485 applications.

Once done I have called the Customer Service and confirmed the address on my pending 485. They have my new address.

No, you absolutely do not need to send a letter to USCIS if you have already changed the address online. If you completed the AR-11 part and then went on to complete the pending applications part, you have done all there is to do. Again, the letter you got in the mail should confirm this.

if you have confirmed that they have your new address then no need of sending letter.
