getting out of US for a whille

hello,

please I need advice regarding what i should do . we won green card in 2008 and moved into US in march 2009. we have just decided its better to return to our country for a while to resolve some issues and the return when we fully prepare.
i am not so clear about what the rule says but i have read many times on the forum that its possible to obtain some kind of permit that will allow us to stay more than a year outside US.
please kindly advice on what to do, thanks
 
You can get a certain permit so you can come back. It cost some money....It will delay the time to become a US citizen though.

You need to file Application for Re-entry permit I-131 for every GC holder (I believe with Nebraska Service Centre) and you have to file it 30 days before you leave US. It is valid for a max of 2 yrs and can be collected outside US (at the US consulate in a foreign country). Check the USCIS website for more details. Look for Form I-131 - this form is used for multiple purposes so take a look at the I-131 instructions for "Reentry Permit". Check with a lawyer the implications of staying outside US for more than 6 months.

thanks, i downloaded the forms, and read there that if one is going to be out of US for less than a year one does not need the re- entry permit, but people often state 6 months. why is the difference?
please help clarify
 
From what I have read on different forums it can also be different from one custom employee to another. If you haven't been over here for a long time and leave for 1 year, you have a chance you will have trouble getting in, so you better get the re-entry permit, which will cost money per person.
 
Yes, the re-entry permit (RP) is a good thing to have if you plan to stay out for long, even if it's less than a year, but over 6 months, especially if you are a new immigrant. You have to apply for it in the US and do fingerprinting before you leave, after which you can ask them to send it to a US consulate in your country.
