Filed I-130 for my sibling. Now what's next?

I sent out I-130 petition for a sibling. According to online tracking info, it arrived at Chicago lockbox on June 22, 2009. What shall I do next? When do I expect to hear from USCIS?

I-130 approval could be 3-5 years. Green card for your sibling around 12-15 years.

the processes run simultaneously. Approval may take any time, but it doesn't matter much as long as the priority date is not current. Do a search on the forum with words priority date, current and visa bulletin.

It is not surprising that the Sibling Cases take 10-15 years to be completed. I am a USC and weighing the sponsorship options for my brother. Hopefully this will get better if they enact Comprehensive Immigration Reform as envisioned by Democrats in Congress.

it will not get better. It will get worse. They'll give GCs to all the illegals, and legals will have to wait for 20-25 years instead of 12-15.

Your sibling is looking at 12-15 years before joining you in the US.

I searched in this forum. It seems that I should receive a receipt for my I-130 petition in the mail a week after they received my petition.

Since they got it on June 22, 2009, I should get a receipt anytime. Is that correct? I just want to make sure I don't miss anything in the long process.

Look at my signature.

5/13/09: I-130 filed for brother
5/26/09: NOA
-------------
5/28/09: I-130, 485, 765, 131, 864 filed for mother
5/29/09: package received at Chicago lockbox
6/11/09: both checks cashed
6/10/09: ND
6/17/09: NOA
6/20/09: FP Notice (7/7/09)
6/24/09: FD Done (walk in)
6/25/09: LUD (765, 485 touched)

What's "NOA"? What's "ND"? Was FP (fingerprint) done on 6/24/09 for both your mother and your brother? If yes, should I file I-130 for my father and my sibling together so that it will speed up the processing of my sibling?

The I-130 Receipt, and the date it was received.

No, since the brother is not eligible to file an I-485, and will not be until 2020 or so.

If yes, should I file I-130 for my father and my sibling together so that it will speed up the processing of my sibling?

You absolutely MUST file the I-130 for your brother, to establish the priority date. Filing them together won't speed things up any.

Just wondering, if he files for his brother, and his father will also file for the son after getting own gc, what will be the PD for dad's petition? The day dad filed, or the day brother filed?

If the FB4 I-130 was approved, then the priority date can be ported to the FB2 petition. That's the best way to do it.

The other advantage of the FB4 petition is that it keeps things alive if the brother gets married, which would void an FB2 petition.

I heard that if my father files for my brother after he (my father) gets GC, it'll take a very long time for my brother to be able to come to the U.S. as well. It probably won't speed up too much because my father is only a GC holder (not a USC).

Also as mentioned, if my brother marries, that may invalidate my father's petition. Of course I can take over once my brother marries; however, I'm concerned that switching between me and my father may mess things up.

I am kind of in the same situation. I have already filed for my mother. My younger brother is not in the US. I was planning to have my mother apply for my brother once she gets her GC.

Would there be any benefit if I file an I130 for my brother right now?

I heard that it would take about 8 years for your mother to get your brother over to the States if she is only a GC holder. That's a long time.

If your brother gets married in the middle, your mother will no longer be eligible to be his sponsor. You'll then have to file I-130 for your brother. That'll mess things up.

Btw, I forgot to mention, my brother is 19 right now - he will be 21+ by the time he gets his card through my mom.

He will not get married in the mean time, I can say that for sure.

Given this - Would he benefit from my petition?

Of course. Your mother's petition would be automatically voided when he gets married. Yours would not. Additionally, you can file for him now, your mother cannot.
