Oh, what a wealth of information :) . The delay in adjudicating your case is horrible :(
 
EAD and AP renewal

Folks,
our second EAD's and AP's are expiring on 05/23/05. Unfortunately we could't apply within 90 days time period of EAD renewals. If we apply it next week, and suppose we don't get EAD's within our expire date... what are the consequences we will be forced to face. What will happen to our status for the days without EAD?

I tried all the options you listed and by God grace, I got Sandy who really helped me with the info I needed. I strongly advice you to write a letter to Mr.David Hardy or to Mr.Hooton and I am sure you might have already have requested FOIPA, so send copies of all the documents along with the letter and I am sure it will have some affect. Quick question. When case will be allocated to adjucator, all the checks should be done (not sure, I read somewhere this). My case is allocated to adjucator and got denied. Now I filed MTR got receipt no. Also I received e-mail from FBI stating my name check was never requested and my spouse check was requested and cleared on same day in oct 2003. what is good time to contact after receiving the 290b receipt or after I-485 message change to case opened? general trend is when MTR is approve/accepted, applicant see approval in couple of months. Now what adjucator will do? he will request for name check before approving, if case meets all other criteria? I am really confused.

It is possible that your name must have been cleared by FBI and therefore adjudicator went ahead with processing. For some people FBI response didn't have any bearing on their name check for approval. Now wait till the I485 message change to show that it has been re-opened. My guess is that if name check is not done they would request for one when the I-485 is reopened. At that point you could try to expedite with FBI. This whole process is confusing.. :confused: :confused:

some one attached I-485 sop. It says that all these checks done in file maintenance stage. then once all the checks, finger printing are done, then only cases will go the adjucation and then allocated to adjucator.
I will go through it today one more time.

I have copy of I-485 SOP, Not sure how to attach..

According to my lawyer you cannot work with a expired EAD even though your renewal EAD is pending approval. You cannot apply for a temp EAD at Local office as you have not completed 90 days of renewal EAD application. Talk to a lawyer. This is a very tricky situation. This could impact your I485 case. Talk to a good Lawyer before continuing your work if you come to a stage were you have not received you new EAD and your old EAD is expiring. (do all these activity before hand not at the enth hour)

Don't try to paste SOP as there is a link to it on this forum as I once read it and if anybody is interested they can search it on the forum.

And regarding your name check issue, as per my experience, there are two kinds of theories.

1. The cases go to adjudicator after all the checks are done including IBIS, FBI Name/DOB check, FBI Finger Printing Check and then adjudicator decides on the case.

2. The cases go to adjudicator even if the certain checks are not done.

In my case when I contacted the USCIS through my congressman in Nov 04, I was told that our cases have been assigned to the adjudicator in the last week of Oct 04 and I should be hearing something soon, but in the first week of Nov 04, I also came to know from FBI that my name check was never initiated by USCIS. Then after 60 days we contacted USCIS, I was then told that my FBI Name Check is pending.

But a friend of mine told me that in his case as he also had the same name check issue and he got it resolved and then when he followed up with USCIS, he was told that now that all the checks are completed, his case can now be moved to the adjudication section and he got GC approved in like One month from then.

So finally it is very difficult to really know how USCIS works! :confused: I personally think that the first scenario is correct then the second scenario.
 
Dear All,
I wrote a requesting email to FBI NNCP office on Feb 18th 2005 asking for some written proof and today they sent me an email confirmation that my Name Check was requested on Feb 9th and got cleared on the same day.

Finally now I can offically say that my Name Check has been resolved. :)

Good Luck to others who are waiting in this painful journey of GC!

I was also told that they are working the emails received on Oct last week of 2004. I called the direct number of Mr.David Hardy's Office which I got from Rahul Kumar Name Check PDF Document.

As I approached the congressman office, they informed my name check was cleared on 7th Feb, but on 15th Feb I got an email from FBI saying my name check request was not received (they responded to my written request mailed in Dec,'04), so I called vermont service center to check if name check request was issued or not, I am not sure what's wrong with those guys, even though I informed about this issue before, some how the service rep, did not follow it up and, they have not issued a name check request.

Hoping this time they would issue my name check request.

why do you need another name check request if name check was cleared? It looks FBI, USCIS and COngressmen's office are living in stone age era..where communication used to take weeks and months between two towns.

Finally, I got a response for my wife's namecheck status email request send on Oct 01, 2004! Now the wait for the USCIS begins!

Namecheck originally requested in March 2003 but it "fell through the cracks". My wife initiated a status request through NCS in Oct, 2004 and USCIS initiated a second namecheck in Oct, 2004. I had made email requests every month starting Oct 01, 2004. Finally today, I got a response (to my Oct 01, 2004 email request) from the namecheck dept acknowledging the above two namecheck requests by USCIS. It also indicated that today the namecheck was completed and the results were forwarded to USCIS.

Please Advise_got confused...

Folks,

I am confused please advise..

I am one of those luck ones, USCIS never requested name check. After I expdiated to Congressman office, VSC told they have requested name check on Feb 5th. However, I got email back from FBI on Feb 26th stating thay haven't recieved the request.

I called VSC but they said they can't say anything :-( Couldn't get help from Congressman Office as well.

Any similar experince ? what should I do ?
