FBI Name Check - 'NO REQUEST FROM USCIS' - Next Course of Action

I'm also facing the same problem. Received an email response from fbi, they have no record of name check request from uscis.

PD : APRIL' 2001
ND : 12/23/2002
RD : 01/27/2003
FP2 : JULY, 2004
 
Can Anybody tell me the number or email to contact FBI

Hello,
We had opened the query with INS on Decemeber 14, 2004 to know what happened to our I485 approval after waiting for 30 days we did not get any response. So on January 18, 2005 our lawyer called INS and they said wait for another 30 days. If you do not hear in this 30 days you can open a query and even after that we dont hear they will tell what next step to take. We are allowed to open only three queries, that is what they said. Also my friends who have filed there I485 in august 2003 got there approvals. We are January 2003, but not heard anything as of yet. Can you please pass the email or phone contact for FBI. And what steps should we take to contact them

You can write an email to fbinncp@ic.fbi.gov and they will update you with the status.

If you do a search on FBI Name Check format, you will finds tons of info.

Interview with IIO at Newark

Hi All,
I went to INS Newark Office and talked to an IIO about the pending name check issue and I have cleanly explained him the problem and showed him all the documents from FBI and USCIS and requested him to tell me what's going on and how he can help me in resolving this issue and to my utmost surprise, he told me that since the case is in still in Vermont Service Centre and Newark Office is one level below VSC, he is not authorised to initiate a name check and he told me bluntly that he doesn't want to get involved in this security mess. and he asked me to keeping writing letters to Director VSC and not come to Newark till the file is not transferred to the Local Newark Office.

So in brief, we are all here now at the Mercy of USCIS and FBI and I am sure that none of them wants to resolve this issue as quickly as possible and so we are all here for a long painful wait.... :confused:

I think we have hit the brick wall. Only way out is to sue USCIS so that they explain what is going on to the judge. How many are there on this forum who would like to get together for quick resolution...
 
Manifest Update

I was very upset with the IIO response at Newark and I finally decided to call VSC again and luckily, I got a good rep who sypathised with my pending case (At last some body from USCIS) and told me that My Name has been added in the "manifest" which USCIS is maintaining for all cases who are reporting the Name Check Issue to VSC and once in one or two months, (not sure about the period) they will send the "manifest" spread sheet to FBI Head Quarters in Washington D.C. and then only on VSC system, it will show that the Name Check is pending. Rightnow there is no information about Name Check (Pending or cleared ) against my case, so she told me that the manifest is still not sent to FBI and asked me to call in 2 to 3 weeks to check.

Once we know that the name check is pending status, then we can safely assume that our names are with FBI and we can write letters to Mr.Hardy to expediate it on case by case basis.

So for all whose name check was never initiated by USCIS, I would probably ask them to write to VSC about it as it will help in clearing this dead lock.

I remember geemboomba also mentioned in one of the threads about this manifest thing and so I think we can go by the above theory.

Anyone else heard about the manifest list

The "manifest" list mentioned by needhelp1 seems to the light at the end of the tunnel. Anyone else heard anything similar? Please post.
 
It's does not look like light at the end of tunnell. To me it looks like a long wait.
My case similar to needhelp, rajumdm and geemoomba. I also spoke with a rep at vermont center, the rep said my name check was requested in September, 04, but the email response from FBI was dated 15th January, which says they have no request from USCIS. I mentioned about the email from FBI, for that the rep mentioned, it goes to washington d.c. from there it will get forwarded to FBI, that's the reason FBI didn't have my name in their database (assuming that washington d.c is the manifest file), it was almost 4months and, FBI did not have the request. Not sure when FBI will have the request and, how much time they will take to respond to vsc.

When I talked to the VSC rep, she told me that the only way the name check can be expediated if they get a request from congressman or senators office, and she told me that this is the only way and all other cases will have to go through the manifest spread sheet to FBI. So we need to actively persue our cases through our local congressman.

name check cleared!!!

Just now I received a mail from FBI (Dave), stating my name check was cleared, I was one of the victim, which USCIS has screwed, by fluke or miracle, they initiated the name check on Dec 27/04, cleared on Dec 29/04.

Please tell us the sequence of actions you took before and just around December 27th. (EAD, APs, status inquiry etc....)...I am wondering what made them initiate a name check. This will help others.

sent letter to USCIS stating their error with facts & evidences:11/15/04
name check wa initiated for self & spouce on 12/27/04
FBI cleared (both) on 12/29/04

I believe FOIPA has helped for quick responce from FBI, if not they would have kept the file for long time. Pl try to fight with reasonable language, nothing wrong in pointing their error. If not we are the suferrers for long time. Hope this helps.

what was the error in facts and evidences you pointed out to USCIS ..was it via fax or mail?

I have initiated FOIPA with FBI, sent expedite request to USCIS. USCIS responded with their generic stupid fax (security clearance etc....). Yet to hear from FBI regarding FOIPA. If needed I can do FOIPA with USCIS on I485. Hope something leads to productive case processing.

Hi Rajudm,

Just now I got a mail from FBI saying that responding to your email dated October 26, 2004, concerning the name check status of you and your spouse
The FBI completed a name check for the both of you on May 8 , 2003, and the results were forwarded to the U.S. Citizenship and Immigration Services,
Washington, DC.

Initiated status enquiry uscis on Nov-23-04 and got a response saying that wait for 120 days to hear from us pending service consideration.

Still I don't understand FBI says Name Check cleared and what is problem with uscis to approve the case. Any idea's ???????? . I am in eb2 category. I appreciate anyone's help in this regard.

It looks like the communication of FBI-USCIS failure has affected you. It is the same with some of us where there in 'no name check request'. Now you need to send an expedite request to USCIS by attaching this e-mail. USCIS may not have recognized that the results of name check for you is back.

I just sent a letter giving all our details, enclosing the copies of FOIPA, email from FBI, stating USCIS has not initiated name check, mentioned current processing dates, sent through mail, VSC/director. Called couple of times to VSC, ofcourse she warned me, not to call any more, I wish you good luck, sorry for the delay reply.
