Eb3- Cut off Date as on Oct 1/ 2005

Having said that, we still do want to discuss eb3 and priority date progress
Don't we? Because thats what keeps us moving.

And this is what came of it.
Lets throw all openions in to the hat fully knowing that this is pure speculation
And wait for what turns up hoping that we hit the jackpot.

I like this game! I checked google hoping I can see some breaking news every day, and then I come here to seek comfort. I think it’s reasonable to discuss this to let time pass by. After all, on the hindsight, every day passed makes our filing/adjudicating date closer.
I have three guesses for retrogression affected countries on Oct bulletin:
1. after Feb/2003-------my fantasy, then I can file myself;
2. June/2002------realistic
3. Oct/2002-------optimistic

NSC04Filer, you got the point.. USCIS need money..so they will definitely open PD's so that people file massive I-485's. then later they retrogress. USCIS will now get EAD,AP revenues from these new set of applicants. A nice way of cheating.

Hi Everybody !!!

I think the Cut of date will be June or July 2003 , when the law aproved that the I140/I485 concurent filling !!! Because from that date , the new cases were processed faster , and the older cases , with earlier PD , were left ...alone !!! For me sounds more true !!! What do you think guys ??? :confused:

I dont see it anywhere on their website. Although I wont be much surprised if that is so.

I think i saw a couple of guys who have prioirty date in 99.
There are however a lot of Labors lying around with Desi Bhadwaas who are putting them up for sale.
This is where doing away with Labor Substitution will help.

I figured that its not possible that this mode of auctioning the Labor is not tapped by these Bhadwaas and did a search on eBay for Labor and Certified Labor. It did not retrun any valid results, i was sure I will get some hits.

Now that this idea is out in the open I guess someone sleazy bhadwa is going to jump on the idea.

Here are the going rates that these bhadwaas charges these days. This may be a good starting point for a eBay posting.

EB2 LC with PD in 2004 - $5K with $15 per hour from the billing rate (BR).
EB2 LC with PD in 2003 - $7K with $15 per hour from BR.
EB2 LC with PD in 2002 - $9K with $15 per hour from BR plus I-485 will be filed after 6 months of applying I140.
EB2 LC with PD > 2001 - $10K with $20 per hour from BR plus I-485 will be filed after 6 months of applying I140.

EB3 LC with PD > 2002 - Cureently useless therefore Free, with no strings attached.
EB3 LC with PD in 2001 - $2K with $5 per hour from BR
EB3 LC with PD in 2000 - $3K with $5 per hour from BR
EB3 LC with PD < 1999 - $5K with $10 per hour from BR.

Once the new PD for Oct 2005 comes out the EB3 rates will change. And offcourse all Lawyer charges, INS application fees will be the responsibility of the employee. The employee would not be allowed to choose his own lawyer, and may only communicate with the designated company lawyer after getting permission form the company first.
The person would have to transfer the H1 to the company and all H1 trasfer related costs will be the responsibility of the employee.

Shipping and Handling charges $1500 applies to all EB2 LC's with PD < 2002.
Any bids placed will not be retracted, please place your bids only after sending in all your documents pertaining to the H1 Transfer. The winning bidders H1 will be transferred immediately upon winning the auction.

Note: The company will not be responsible for placing the bidder/employee. Its encouraged that the bidder bring a client before bidding. The company would become an offcial vendor for the client from the point of the bidder joining the company. Even though the bidder/employee bring his own client he will not be permitted to have any offical communication regarding rates or anything with the client.



Bhadwaas are welcome to take this as a starting point for their eBay posting.

I hope you are not confusing with Prioirty dates which are still unavailable for EB3. This is just the processing time. If your PD is current and your 485 was filed before this date then your case will be eligible for adjudication.

Please where did you get the information about "Priority date will be June 1, 2002 when I-485 becomes available again"

What does it mean? my federal LC was requested Feb 2003, I am still waiting for its approval at some point I will need to apply with I485, does your statment mean that there will be no visa for me because the USCIS will process ONLY I485 before "June 1 2002" ? if yes when are they going to accept my I485.
