GC approved in the interview for derivative

Hi

On OCt 28 2004, my wife's GC got approved. Her case is a derivative case of mine. Though mine was approved (EB1-OR) in March 2004, my wife's case was transferred to Boston office for an interview. They initially set up an interview in Aug 2004 and later sent another mail saying that it got postponed to Oct 28 2004. Her interview was at 8:30 AM and they sharply called her at that time. The first question they asked was whether we had come with our attorney. We said "NO". I was initially puzzled at this question anway. We took all the documents (whatever possible) and to my surprise they didn't even ask for any document. Just they took her EAD and asked her if she took treatment (TB). That is all. She stamped her passport and asked us whether we know what that means. All these were done in less than 15 minutes and were out by 9:00 AM.

To brief my story, EB1-OR , I-140 filed on Mar 02 2002(RD) and I-485 on Oct 06 2002 (RD), finger print Nov 18 2003 (after one year and 8 months). Nothing happened till Jan 19, 2004. My I-140 got approved on Jan 20 2004 (after 1 year and 10 months) and I-485 got approved on March 15, 2004 (exactly after 2 years and 13 days) and GC came in April 2004 (within 4 weeks). I lost my job in Oct 2003 and picked up another in Feb 2004 (out of job for 4 months) and finally everything went fine for me. Within 2 months of time I got all approvals which I didn't expect at all.

Good luck to all. The INS Officer at Boston told us that now they are sending out the plastic cards quickly.

Thanks a lot for the good wishes, and good wishes to everyone waiting (includes me!). Hopefully, with election behind us within a day, govt workers will get back to work and VSC will keep on approving cases.

We both did go for FP2 together 7/17/04, and our last 3 LUDs prior to my wife's approval were all on the same dates - 8/26, 10/5, and 10/6. So I dont know why they did not approve mine simultaneously.

Right now we are celebrating, and I shall worry about my case only starting next week...

Is an attorney a must during an interview?

Hi Guys

From this forum news, I understand that taking an attorney to the interview will be a safer bet than not taking one. As I learnt from varuious sources that it takes just $500 for that purpose. I didn't take any attorney for a simple reason that I felt they don't have anything to question given a situation that my GC was approved and I have it in hand along with my daughter's GC (4.5 years old). Moreover my attorney is an attorney for my previous employer and I doubted whether he will come over to Boston from New York just for this case. Though the attorney is personally a nice person and I took his telephone number with me in case it is necessary. Because the case is for a derivative, I didn't bother too much about it and it went on well.

My opinion is that for a primary applicant it is always advisable to take an attorney just to
save further agonies one has to go through this process.

need help about the message change...

dear friends,
i need help for the message change on one of my file. my I-129 was pending since may'2003 and rfe for that and replied in nov'2003. now today when i looked at the message it is something that i dont understand. it says like this "On November 4, 2004, this case was transferred to our Administrative Appeals Office for review. That office will notify you of any further action taken on this case."
does this mean that the case has been transffered to local office? or can any one help me that is this positive for my case? or it is somthing fishy there?
please help.....
